My brother was tried and convicted of a horrible crime. I was present throughout the trial and can say his counsel was incompetent to say the least. This resulted in a conviction of 40-75 years. He is currently 34 years old and has 2 daughters (that I now take care of). He was charged and wrongfully convicted of sexual assault of a minor. Here is the kicker: There was/is no evidence of any sort of penetration. Doctors' reports stating this and the Prosecuting Attorney even opened with the statement that they did not have any physical evidence. The only evidence was his semen on a blanket. A blanket that the "child" stated went everywhere with her.


Also, the prosecution's "expert witness", a doctor, states that the female hymen is able to regenerate itself in young girls and this is why there was not any signs of penetration. The accuser also stated on the stand under oath that she was stating that which had been told to her...

Because of all that and my brother's (and my family's) inability to hire a paid attorney ($25,000 - $75,000 to take the case) he was appointed a public defender. Throughout the trial my brother's attorney stated multiple times that there was no need for him to do much as the plaintiff was doing his job for him... Then he decided not to have my brother speak on his own behalf because the prosecution didn't want him to and threatened to bring up his criminal history. Yes, he has a criminal history. Of which, NONE of the charges are sexually related in any sense of the word. He has had drug charges, assaults and domestic violence charges that is it... He was offered a plea bargain for a 5-15 year sentence but declined on the grounds that he was innocent and they would have to prove it.

Another note to think about, how many people reading this have every been to a high profile trial? It is my understanding that the jury must come to a unanimous decision of either guilty or not guilty, correct? If that is the case, why would jurors be, literally, crying when the verdict is read? Not one, but multiple jurors..

This case is now public knowledge so please feel free to do some research of your own and sign this petition to get my brother released and these ridiculous charges expunged. He is serving 40-75 years for a crime he did not commit and has lost the right to even see his own children. This has devastated him and them and our whole family.
