I agree that the Santa Monica model looks to be the most realistic approach. It will address at least 90% of the problem, and has withstood appellate legal challenge. So any modifications to it should not be so extreme as to sacrifice that “teflon” quality. (NB: This is not an endorsement of Teflon™.) Also, for effective, inexpensive enforcement, we could borrow from Laguna Beach the requirement of a license to advertise an STR. A compliance officer can check online listings, and if an ad appears not to be licensed, they can call or email to get the address and determine the identity of the owner. The fine is something like $100 for the first violation, $500 for the next. As a bit of perspective, WeHo has banned STR’s entirely (though they don’t have to address Coastal Commission concerns). Reportedly, that ordinance was was written by Michael Jenkins, Christi Hogin's husband/partner. A case study: My own neighborhood is comprised of 30 homes accessed by a common private road. In the past 2-3 years, 5 homes have become STR’s and another 5 have been purchased by absentee investors. So, seemingly overnight, 1/3 of my neighbors have been replaced by sometimes-loud, always-ignorant, transient strangers. This has been a radical change in quality of life.

Its the obligation of the Council to follow the Vision and Mission statements for Malibu , Pass an ordinance that copies the Santa Monica Homesharing Ordinance. The Santa Monica ordinance prohibits commercialized “whole unit STRs” by limiting short-term rentals to primary residences where the owner or operator (host) is on-site while the guests are in occupancy.

All STRs must have an owner or manager living on site full time Only one STR per property. STRs limited to no more than ten per cent of any apartment building’s units providing #1 is met. (right now some have 30%) No trailers, yurts, tents, barns, or any other building not permitted and must comply with all laws and regulations applicable to apartments. Violators to the above shall be banned from having STRs for 5 years. Any STR that permits parties, noise, parking that is a public nuisance and/or a disruption to the quiet enjoyment of neighboring homes/apartments shall be banned from operating STRs after the second incident in any five year period for a period of 1 year. This time period shall double if another two incidents occur after they are reinstated. The City shall hire Malibu residents (preferably in both East and West Malibu) to answer complaints received and who must immediately investigate the alleged complaint by driving to the address of the violation. They shall take video to support their findings. Such inspectors shall be paid $250 to answer each complaint. What else?

One of the arguments for short term rentals is the always used excuse by city staff is "we will be sued" . If we copy Santa Monica's ordinance that excuse goes away. Malibu is becoming a motel a we are losing our school population . Please sign

While I have myself rented my apt on Airbnb, the conversion of my neighborhood into an unregulated hotel is unacceptable. Summers have become unbearable with regularly arriving strangers with suitcases.

Malibu has been an important part of my life since 1979. Nothing can prevent change but together we can certainly steer change in a conscious, environmentally sound direction. To do that, Malibu needs a resident population committed to place and to community.

We have asked, begged and demanded action by city towards regulation, now we have to resort to uniting and growing stronger.
