Privacy Fence Exception
I requested the HOA allow us to build a privacy fence for our daughter's protection. Their response was to install a hedge. This is not a safe enough option to protect a child from a predator. If this were their child, I'm sure they would agree with me.
This is the letter I sent to the ARB:
Dear HOA Review Board,
I am writing to request that the Homeowner’s Association consider allowing us to build a privacy fence in our backyard. Unfortunately, our direct neighbor is a registered sex offender for child pornography. I have attached the flyer from the Florida Department of Law Enforcement.
When we initially contracted this house, privacy fences were allowed at the homes that backed up to the easement. We chose this lot for that specific reason. Upon moving in, we were informed that privacy fences were no longer allowed. We were accepting of that and planned to install an aluminum picket fence that was allowed. After receiving board approval for that installation, we found out about the neighbor.
My husband and I have a 7-year-old daughter whom we have been unable to allow to play outside in our backyard. His lanai and bedroom windows look directly onto our back yard. I am deeply concerned for my family’s safety as I am sure you can imagine. We are seeking to protect her from any potential harm that may occur with this individual being so close by.
We do understand that privacy fences are against the community rules, but are respectfully requesting permission to install a privacy fence. Our daughter would love to play in the backyard of the dream home that we worked very hard to build.
