I agree. This is such a simple matter to resolve through just talks and mutual understanding. I don't see any reason for any legal action here, unless one is trying to find excuses to raise money

Lets start to look at the intent of the covenants instead of blindly following one interpretation of them.

I think the HOA should concentrate on more important issues such as a neighbors garage door that has been smashed in for 10 years instead of a basketball goal.

Seems like a trivial lawsuit, that could be handled another way. Our HOA dues could be used for many other things besides useless lawsuits.

I have lived here for 16 years. Surely other means could have been utilized for problems with a basketball goal???? Sounds almost like a bully with deep pockets vs. a lone homeowner and I am a real sticker for keeping up the neighborhood.

I'm sure there is more to this story; but HOA rules are there to keep junk cars out of front yards, not punish people for basketball hoops, flag poles, etc.

It is very disappointing that such matters are taken to court. It reflects on the neighbourhood and how HOA has been creating an hostile relationship with neighbours. If these things continue, will have to do some serious thinking about living in this neighbourhood.

It seems like a trivial issue that could be easily rectified through proper communication . The HOA at Pinnacle should not create such a hostile relationship with a respectable homeowner. It reflects badly on the neighborhood.

I did ask board members if they attempted to mediate and they said yes. Disappointed they went to mediation demanding additional funds. Law 101 class should have taught attorney what mediation is about.
