Petition to request special meeting of HOA Board of Directors.
Some incidences were occurring under the watch of the current HOA Board primarily in regard to handling of monies and ongoing steady replacement of committee chairs that drew the attention of several concerned members of the neighborhood. This resulted in an in-depth investigation of transactions which brought to light a number of spurious expenditures, one such example was substantial purchase of equipment which was never seen/installed yet receipts were on record and reimbursements were paid directly to board member(s) as they paid out of their pocket (this practice in itself is a violation of the bylaws which you can view on Crest's website). Nonetheless, upon calling vendors to verify the purchases, it was revealed and confirmed that no purchase was ever made. Further investigations revealed more inappropriate spending of the community funds.
I would like to be very clear that this very dedicated group of community members has been thorough in all documentation and has been working closely with lawyers, law enforcement and the management company to insure accuracy in findings and potential allegations. Ultimately, it became exceedingly apparent that a call to action was necessary.
The petition that I am asking you to sign is to “Request a Special Meeting of all HOA Board Members to discuss financial activities. Including a vote to keep or remove Directors: Nathan Hurt, Ralph Ellis, Ronnie Lopez, George Valdez, and Larry Gaithe"
At this meeting, many gathered documentations will be presented and a request for an explanation and clarification of expenditures and other practices. In order to call a meeting however, a quorum of 20% of the neighbor must agree to the request, hence this petition.
So, just to reiterate, this petition is NOT a vote toward removal of board members, it is simply to call the special meeting. You can vote in person at the special meeting or via proxy ballot if unable to attend, proxy ballots are available. I understand that you may not be completely at ease when someone else asks you to support a dramatic action against any group/entity such as when calling for removal of office particularly when you are not intimately familiar with the facts, however the first step of a meeting is without doubt absolutely necessary.
