We, the undersigned residents of Mountain Park Range, Phoenix AZ, and elsewhere attest that we are in opposition to the installationand addition of a Wireless tower on the properties located at and/or near Ray Road and 39ThStreet, Phoenix AZ 85044andcall on the city Planning Department, as well as the Zoning Board to deny this application.
We never have been asked and notified from both sides: HOA MPR or Wireless company.
Located near the proposed site, are many other better suited locations. Surrounding the proposed location customers report excellent cellular service.. As a result an additional cell tower at this location does not offer customers better service in any way.

The installation of more cellular antennas is inconsistent with the character of the neighborhoods surrounding the location. We would hope the City of Phoenix, AZ would discourage antenna or tower proliferation and protect against visual blight and damage to our community aesthetics.The proposed cell tower does not belong near any area zoned for Single Family Residential Use

It will lower property values of the single family homes in this residential community, and residents would seek lower tax assessments as a result of this tower. There are various appraiser journals and industry publications that support the arguments of reduced property values and cell phone towers.


We believe thisWireless and other cellular communications companies should be required to find more appropriate locations in nearby commercial and industrial zones away from residential neighborhoods and that all alternative scenarios must be exhausted to make a more appropriate selection on industrial or commercial land.

Fiduciary duty is a standard of care in a legal relationship of trust and confidence. Fiduciary responsibilities of HOAs are those that require board members (directors) to act truthfully and in good faith in the interest of the association and subordinate their individual needs and objectives to the best interests of the association. Board members have an obligation to not abuse the power they have or exert undo pressure on others and they must always act with the knowledge and consent of the homeowners in the association.
