Introduction

"Initiated by Elijah DeSousa (Legal Name: Eliseu DeSousa), on behalf of the residents of Massachusetts, this petition demands immediate legal and legislative action to halt, investigate, and reverse the extortive rate and delivery hikes imposed by Eversource Energy and facilitated by the legislature."


The Time For Action Is Now

Enough is enough. The people of Massachusetts are not pawns in a corporate game, nor are we commodities to be exploited by unchecked monopolies and complacent regulators. We are the backbone of this state—families, workers, business owners, retirees—who rise each day and give our all to build our communities. And yet, while we struggle to put food on the table, to keep up with rent, mortgages, healthcare, and basic necessities, Eversource, backed by feeble oversight and silent enablers, dares to take more.

A society collapses not in the wake of a single great blow, but under the weight of many small burdens, layered one atop the other until the people can bear no more. We refuse to stand idly by as the cost of living is artificially inflated through reckless corporate profiteering and bureaucratic negligence. This is not just a battle against a utility company—it is a stand against the slow erosion of fairness, the quiet theft of prosperity, and the institutional betrayal of the people's trust.


The Citizens Of Massachusetts Are At A Breaking Point And On The Verge Of Financial Insolvency

Residents are facing extreme financial distress due to extortive rate and delivery hikes that disproportionately burden consumers. Hidden fees and public interest charges do not directly benefit ratepayers, while skyrocketing food, housing, and insurance costs continue to worsen economic conditions. Stagnant wages have failed to keep pace with inflation and rising costs, and state policies allow corporate mismanagement costs to be passed onto consumers.

The unchecked increase in both rate and delivery charges is forcing thousands of families toward financial ruin. The legal basis for these increases must be challenged, and all improperly imposed fees and surcharges must be removed.


Expanding The Investigation:

Holding Additional Government Bodies Accountable

1. Executive Office Of Energy & Environmental Affairs (EEA) – Secretary Rebecca Tepper

- Oversees the Department of Public Utilities (DPU) and had the authority to intervene but failed to do so.

-Potential negligence in allowing excessive rate hikes without sufficient consumer protections.


2. Massachusetts Attorney General’s Office (AG) – Energy & Environment Bureau

- Has the authority to investigate consumer fraud and unfair pricing but has failed to take action.

- Did not intervene or challenge the DPU's approval of extortive rate hikes.

- Potentially ignored consumer complaints regarding price gouging by Eversource.


3. Federal Energy Regulatory Commission (FERC)

- Regulates interstate electricity transmission fees and market pricing manipulations.

- If Eversource inflated transmission fees, this would fall under federal jurisdiction.


Legal Grounds For Emergency Injunctions, Reversals, And Legislative Repeals

We demand immediate legal action, including emergency injunctions, a full judicial review, potential reversals of past hikes, and legislative repeals of policies that violate consumer protection laws.


Grounds For Injunction, Reversal Of Hikes, And Legislative Overhaul

1. Violation Of Due Process (M.G.L. Chapter 30A, Section 10)

- The DPU failed to properly review, negotiate, or justify the rate and delivery hikes before approval.

- No public transparency or hearings were held, violating procedural fairness laws.


2. Irreparable Harm To Consumers

- The combined impact of rate and delivery charge hikes has placed consumers in financial distress.

- Many residents are now unable to afford essential energy services, constituting a public emergency.


3. Failure To Fulfill Statutory Duties (M.G.L. Chapter 164, Section 94)

- The DPU is legally required to regulate energy rates and delivery charges in the public interest.

- If the DPU, EEA, or AG failed in this duty, all recent increases should be subject to reversal.



Our Demands


- An emergency injunction to halt the November 1, 2024, rate and delivery charge increases.

- A full judicial review of Eversources’s past increases and the DPU’s approval process.

- A full legislative investigation into the DPU, AG, and EEA’s regulatory failures.

- A complete financial audit of Eversource’s corporate practices and justification for price increases.

- The removal of all unnecessary public interest charges that unfairly burden ratepayers.

- Potential reversal of past rate and delivery hikes due to violations of consumer protection laws.

- The repeal of any laws, including Bill S.2967, that enabled extortive increases.

- A comprehensive review of economic thresholds and financial aid eligibility standards.

I oppose the addition of fees to delivery charges which are support green programs (such as MassSave and EV charging etc) and ever increasing equity programs. They should be separately funded (if at all) and not tacked onto bills of utility customers.

I just got a bill for $1210 for one month - 400 square foot apartment with electric heat and we keep heat on 64 degrees! Delivery charges were $695 alone!!! My rent is $950 / month. This is something I literally cannot pay and I am working 3 jobs! B

Monthly gas bill has gone up significantly when nothing has charged in my household. My monthly bill for this winter is $760 the supply is $277 and delivery is a whopping $480!!! Why?????. At this rate my 5kids and I should just sleep in my car.

Racketeering. No way should we have this many fees nor should they be tied to consumption. Moved from Texas where we had A/C running non stop in a home 1,000 sq ft bigger and the most we paid was less than 200/month. I usually pay 600/month here.

Enough is enough. The tax payers of Massachusetts should not have to fund the subsidies of solar and wind boondoggles. If those technologies worked, they wouldn't need subsidies. Bring in the pipelines and stop passing on rate hikes to the tax payers.

I'm 76 i served in the military and what's happening to country is unbearable.After my meter was charged my bill rose to 244 a month the sad part is no one cares.I worked for a utility company for almost 30 yrs.and I know what owes on its all about the people making his 250.thou a year.This country is on a downfall
