COME NOW, through the below Petition, homeowners and members of the the Estates at Mt. Rose to exercise their statutory rights pursuant to NRS 116.31036(2) and for the "causes for removal" set forth below, to remove DAVID GEORGI, from his membership on the Executive Board. By this action, the homeowners and members of the Estates at Mt. Rose claim that member Georgi and his representation of homeowners while serving on the board over the past two years has: CAUSES FOR REMOVAL 1. Interfered with promoting a harmonious living environment at the Estates at Mt. Rose; 2. Supports a failed communication governance style that promotes a programmatic, discretionary and unsubstantiated distribution of CC&R violation notices including assessment of fines to homeowners by the Association management company; 3. Continues to misapprehended the interpretation and application of powers of the Board by promoting rule changes inconsistent with and not reviewed or approved by the Homeowners,and, among other things; 4. Holds a disruptive governance attitude inconsistent with the desires of homeowners. NOW THEREFORE, through this Petition and by their signatures, Petitioners inform the Executive Board to take immediate action to: 1. Distribute a secret ballot to all Homeowners of the Estates at Mt. Rose pursuant to NRS 116.31036; 2. Set forth in the ballot the name of the member named in this Petition to be considered for removal to include a disclosure of the above "cause for removal"; 3. Distribute and collect the ballots allowing for no less than 45 days from receipt of the Petition; 4. Schedule a meeting where the secret ballots may then be opened and counted within no less than 60 days from receipt of the Petition and set a date for the removal election to be no less than 75 days from the receipt of the Petition, if the election is so approved by secret ballot count.
