Petition for Investigation and Audit of False Claims Under Title 4D Program
This petition is submitted by private citizens who are concerned about the integrity of the Title 4D program and the potential misuse of federal funds. We urge the relevant federal agencies to investigate and audit the false claims made by state agents for not following CFR 45 303.2, 42 USC 1301(d), and due process, in accordance with the False Claims Act (31 U.S.C. §§ 3729–3733) and related statutes (18 U.S.C. § 666 and 18 U.S.C. § 1031).
To the Department of Justice, Civil Division; Office of Inspector General for the Department of Health & Human Services:
We, the undersigned, are private citizens who are deeply concerned about the administration of the Title 4D program and the potential for false claims to be made against the federal government. We have reason to believe that state agents, including admin judges, state DHHS officials, and other agents, have been knowingly violating CFR 45 303.2, 42 USC 1301(d), and due process in their handling of cases related to the Title 4D program. Requests for the process to review how states both open and vet these cases, to make sure that there is a need, and the process to close out these cases, meant to be temporary, have been ignored/denied. We request of Freedom of Information Act release of these procedures, as submitted to the federal agencies, to be in compliance with funding regulations. These violations appear to be motivated by a desire to ensure that their state continues to receive additional federal funding, despite non-compliance with federal regulations and statutes.
We request that you:
- Investigate the actions of state agents involved in the administration of the Title 4D program to determine if they have knowingly violated CFR 45 303.2, 42 USC 1301(d), and due process.
- Audit the financial transactions and funding allocations related to the Title 4D program to identify any false claims or fraudulent activities that may have occurred as a result of these violations.
- Hold accountable any individuals or entities found to have knowingly submitted false claims or engaged in fraudulent activities in violation of the False Claims Act and related statutes.
- Implement measures to ensure that future administration of the Title 4D program complies with all applicable federal regulations and statutes, and that due process is followed in all cases.
We believe that a thorough investigation and audit are necessary to uphold the integrity of the Title 4D program and to protect federal funds from being misused. We urge you to take immediate action to address these concerns and to ensure that the program is administered in accordance with the law.
