Red States Must IMMEDIATELY Enact Legislation to Recall US Democrat Senators of their State

The Urgent Need to Recall Democrat US Senators:

Whereas We the People the true Sovereigns of the States and Nation, having witnessed during the last 4 years, we believe, the systematic dismantling of our Liberties by President Barack Hussein Obama, and he circumventing the Consent of the Governed, issuing executive orders, thus by-passing the authority of The People’s duly elected Representatives in Congress. Congress also is being effectually handcuffed by US Senate Majority Leader Harry Reid who for all that appears, refuses to take any action against such Presidential abuse of power, being in lockstop with the White House on virtually every issue, aided and abetted also by his underlings in the Democrat Party Senate who have not, for all that appears, attempted to persuade Senator Reid otherwise.

It is for the above cited reasons and more, that We the People, the true Sovereigns of the States do now authorize the Governor, House and Senate of our respective States to immediately enact legislation to empower themselves, as the People’s Representatives, with the Right to Recall any sitting US Senator of their State, but at this time, and for reasons already mentioned and more, that Red States recall said faithless US Democrat Senators of their State, and that they be replaced with known faithful servants, preferably of an opposing party, pursuant to the successful passage of the requested Recall Legislation.

Right of Recall is Now Established Fact

With the recent publicity regarding the attempted recall of Gov. Scott Walker of Wisconsin, the nation has now been sufficiently awakened to the People’s Right of Recall of Elected Officials, and as observed by all, in the case of Gov. Walker, for nothing more than mere policy differences! There was no illegality committed on the part of Gov. Walker, or other such behavior, and yet for mere policy differences he and his companions in the State Senate were subjected to Recall, none forbidding. As was the case of Gov. Walker, the requested Legislation may forbid the Recall of a US Senator for a period of 1 year from election.

The 17th Amendment

The 17th Amendment of the US Constitution is not a GUARANTEE of safety in office, regardless of ones’ behavior. Even a sitting President can be impeached by the People’s Representatives in Congress. US Senators are elected by the Sovereign People of their respective States, and thus they serve by the Will of the People of that State, and by no other. Since We the People also duly elected a Governor and State Legislature to govern its Citizens, including those elected to represent us in the US Senate, it is our contention that by this The People’s grant of power, that State Legislatures are empowered to enact the requested Recall Legislation wihtout the need of a Petition from the People of their State.

While we ask specifically that US Senate Democrats from Red States be recalled by their States at this time, this legislation would obviously apply to any and all in the US Senate, regardless of party. In fact, the 17th Amendment empowers Governors and Legislatures to appoint a US Senator if a vacancy occurs, the reasons for that vacancy, for all that appears, is not limited to accidents of circumstance. And why does the 17th Amendment allow States to appoint a US Senator, if a vacancy occurs? Because they used to be appointed by State Legislatures, and thus could be DIS-appointed at will by that same Legislature.

We the People contend if a State Legislature is empowered by the US Constitution to replace a US Senator to fill a vacancy, and that no specific situation is mentioned just that "a vacancy occurs"...that the 17th Amendment thus does not forbid the Recall and Replacement of said Senators by the same State Legislature when they prove to be faithless to the charge commiteed to them, nor does the 17th Amendment require they be replaced with a person of the same political persuasion.

We the People believe that this Right of Recall of US Senators of our State, thus firmly established, will have a salutary effect upon ALL that serve in public office at the Federal level, should they think to infringe on the Liberty of We the People of the States in the future, being held immediately accountable to the People’s duly elected Representatives of the State.

The 10th Amendment

Does this really need much explanation? "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the People." Recalling Federal Elected Officials is a power NOWHERE PROHIBITED to the States by the U.S. Constitution.

To Sum It Up

I close with the following two quotations from James Madison, regarded as the Father of the US Constitution:

Federalist #46 - “The argument under the present head may be put into a very concise form, which appears altogether conclusive. Either the mode in which the federal government is to be constructed will render it sufficiently dependent on the people, or it will not. On the first supposition, it will be restrained by that dependence from forming schemes obnoxious to their constituents. On the other supposition, it will not possess the confidence of the people, and its schemes of usurpation will be easily defeated by the State governments, who will be supported by the people.”

(In case you missed it : State Gov'ts have the RIGHT to DEFEAT unconstitutional usurpation of our liberties which come from DC, and WILL be successful when supported by the People.)

“For security against oppression from abroad we look to the Sovereign power of the U.S. to be exerted according to the compact of Union; for security against oppression from within, or domestic oppression, we look to the Sovereign power of the State. Now all sovereigns are equal; the sovereignty of the State is equal to that of the Union, for the sovereignty of each is but a moral person. That of the State and that of the Union are each a moral person, and in that respect precisely equal,” James Madison, 1835

We the People of the States are looking to you - Governors and Legislators of the States - for leadership to thwart and resist the usurpation of our Liberties and the Liberties of succeeding generations, by any and all legal means possible. We must do this while we still have the freedom to resist tyranny from DC.
