Dear Governor DeSantis,

Mark Herman was convicted for a crime, murder in the first degree back in 1978 which he didn't commit. The murder of Richard Kreusler, a 47-year-old oil distributor and unopposed candidate for the Palm Beach Town Council when he was fatally shot on January 16, 1976, at the front door of his home at 272 Via Marla in Palm Beach, Florida.

There were NO eye witnesses, only the testimony of convicts already serving 5 years to life, whose sentences were commuted to time served and released from prison and Gerardo Denono, also known as Gerald Denono or Jerry English, was a convicted American murderer and former FBI informant with ties to organized crime in Las Vegas and South Florida during the 1970s. He was spared the death penalty!

He was a self-proclaimed mob hit man who was convicted of multiple murders!

Every single witness for the State has admitted they lied to get their own charges reduced and it helped Mr. Jack Scarolla to use Mark Herman's case to get him into the State Senate - but he failed, but became a millionaire off the blood of Mr. Herman's family.

Even the victim's family has spoken out and let former Palm Beach County State Attorney Dave Aaronberg in Florida, serving from 2012 to 2024, know they got the wrong guy.

The victim's family knows Mark Herman did not kill their father!

I never thought I would be in this position. But I think it’s time we recognize the enormous injustice visited on this man. He and his family, like ours, have suffered. He did not kill dad. Letter from Kathleen (Kreusler) Kelly:

"I’m sure you’re all wondering if Patti & I have additional information to send – we do. We both, together with Mom, have spent years looking into Dad’s murder and, in order to determine the “who” & “why”, we first had to ascertain if Mark Herman was involved in any way. After exhaustive research, we firmly believe he wasn’t and, because of strong political pressures, was targeted as the murderer. He was the perfect “fall guy” – a legend on the streets who had already been arrested for several crimes. The attached chronology outlines exactly how and why Mark Herman was indicted and eventually convicted, together with what transpired after the trial.

When Herman was granted clemency in 1992, I think we all thought it was “over”. Unfortunately, it’s not. Herman was never granted a “pardon” – a condition that would totally remove the murder conviction from his record. We recently learned that the only way for Mark Herman to obtain a pardon is for our family to write a letter to the Clemency Board asking them to grant the pardon. This should not be done without all of us agreeing – we would NEVER want to do anything that would affect the incredible bond we all share. Mark Herman is 74 years old – we think it’s time we clear his name and give his family solace from knowing he is not a murderer. Nothing we do now will ever give us back all that we lost, but we can be instrumental in giving another family peace."
