The Petition of certain citizens of the State of New York residing in Community Board 3 oppose theliquor license applications and / or expansions for The Derby (167 Orchard Street), Epstein's (87 Stanton Street), and Nuevo (112 Stanton Street):

1) Oppose "Epstein's, 82 Stanton Street" liquor license (OP) expansion to two (2) additional floors that include alteration for one (1) service bar and one (1) stand-up bar for a "restaurant" and "private event space." to include djs.

2) Oppose"The Derby, 167 Orchard Street" liquor license (OP) alteration of a service bar to a stand-up bar in the basement to include DJ and 4:00 a.m. closing, and option to show special events on non-affixed television monitor.Support trade name change (d/b/a) from "Tiny Fork" to "The Derby", and method-of-operation from full service seafood restaurant to full service "southern comfort" food with option to open for lunch.

3) Oppose "Nuevo, 112 Stanton Street" liquor license application by the landlord for his previously unlicensed storefront with the operating hours of Mon - Wed 12pm - 10pm, Fri - Sat 12pm - 12:30am, and Sun 12pm - 10pm.

The Petitioners request that Community Board 3 and the NY State Liquor Authority deny these applications as stated because of the degraded quality of life, the result of so many licensed establishments within close proximity to each other, overwhelming pedestrian and vehicular traffic, patrons congregating in the street itself, late night horn honking and overwhelming noise emanating from businesses and from patrons as they move between businesses.
