Looking to have the city council amend the Agenda with a majority vote on Monday to hear my ordinance and vote on it. The ordinance Below:

City of Le Sueur Minnesota

Ordinance

WHEREAS, The City of Le Sueur, Minnesota is a political subdivision of the State of Minnesota and is therefore bound by the same limitations as the State of Minnesota and is in possession of no powers not held by the State of Minnesota.

WHEREAS, the State of Minnesota was ordained and established by the people of Minnesota “in whom all political power is inherent,” (Minn. Const. Art I, Sec. 1) by the State Constitution of October 13, 1857.

WHEREAS, according to Article I, Section 2 of the State Constitution “No member of this state shall be disfranchised or deprived of any of the rights and privileges secured to any citizen thereof, unless by law of the land . . . .”

WHEREAS, said “law of the land” can issue only from the Legislature and cannot issue from the Governor. (Minn. Const. Art III, Sec. 1.)

WHEREAS, according to the State Constitution “The powers of government shall be divided into three distinct departments: legislative, executive and judicial. No persons belonging to or constituting one of these departments shall exercise any of the powers properly belonging to either of the others except in the instances expressly provided in this constitution.” (Minn. Const. Art III, Sec. 1.)

WHEREAS, the Governor of the State of Minnesota has issued Emergency Executive Order 20-20 and subsequent orders which, if enforced against the people of Minnesota, would disfranchise and deprive citizens of their rights and privileges including the freedom of religion, the freedom to assemble, freedom of association, their property rights, and their right to the pursuit of happiness, among others.

WHEREAS, the State Constitution makes no provision, express or implied, for the Governor to deprive citizens of said rights.

WHEREAS, the Governor has not even attempted to claim that authority for Emergency Executive Order 20-20 was expressly provided in the Constitution.

WHEREAS, by claiming legislation and not the Constitution as the source of authority, the Governor has admitted that he was given no such authority in the Constitution.

WHEREAS, the legislature cannot confer law making authority on the Governor via legislation; only the people can do so via the Constitution.

NOW THEREFORE, the City of Le Sueur declares that Emergency Executive Order 20-20 and subsequent orders cannot be enforced against the citizens without violating both Article I, Section 1 and Article III, Section 2 of the State Constitution.

AND FURTHER, the City of Le Sueur will not enforce Emergency Executive Order 20-20 against any private citizen or privately-owned business.
