On this day, duly and regularly, all prerequisites of law having been complied with, came on to be heard the petition of Farid Galindo-Gomez, license # TX 01019269, for an Occupational Driver’s License. The Court, after finding that a copy of the verified petition filed herein by the Petitioner has been delivered to the attorney representating the State; after determining that it had jurisdiction and venue under Tex. Transp. Code 521.242(a); after considering the pleadings, hearing the evidence, testimony, and arguments of counsel: after finding that Petitioner has demonstrated financial liability as required by Tex. Transp. Code 601: and after finding that the four-hour limitation under Tex. Transp. Code 521.248 should be waived is of the OPINION AND FINDS that: There exists an essential need for the Petitioner to operate a motor vehicle for transportation for employment, and household and domestic duties. IT IS THEREFORE ORDERED, ADJUDGED, AND DECREED that the Texas of Public Safety issue the Petitioner, Farid Galindo-Gomez, an occupational driver’s license for essential driving needs subject to the following restrictions: 1. TIME PERIOD/LOG: Petitioner is order to keep, at all times, in any car Petitioner drives, a log book, and to accurately record therein the times and purposes for which Petitioner drives. Petitioner is order to show said log book to any law enforcement officer upon demand. Petitioner is restricted to driving no more than twelve (12) hours in a twenty-four (24) hour period. All driving shall be direct route going to or from work or performing work assignments within the course and scope of the Petitioner’s employment, in direct route going to or from post- conviction sentencing requirements, in direct route while performing essential household functions. 2. This license shall be valid for the following counties in Texas: Harris County. 3. DURATION OF LICENSE: This license is to be in force and effect until Petitioner’s driver’s license suspension has expired. A certified copy of this Judgment, together with proof of insurance, shall serve as the Petitioner’s Occupational Driver’s License, subject to the above restrictions, until the Occupational Driver’s License is received from the Texas Department of Public Safety. Petitioner must carry a certified copy of this Judgment when operating a motor vehicle. 4. Petitioner shall not carry in any vehicle Petitioner drives a radar or laser detection device. 5. Petitioner shall not consume any alcoholic beverages for at least four (4) hours before or during any period of time Petitioner is permitted to drive. 6. Petitioner shall not be convicted of any moving traffic violations. 7. Petitioner shall maintain in full force and effect a policy of automobile liability insurance as required by State law. 8. Petitioner is prohibited from driving a commercial motor vehicle with this license. 9. The appeal of the Administrative Law Judgment in __________________________ issue on ________________________ is being held upheld and the appeal is being dismissed.
