We, the undersigned, demand that the Town of Brookline amend its street cleaning operations and stop the persistent noise from street cleaning machinery between the hours of 12 a.m. and 5 a.m. We demand that street sweeping abide by the same guidelines set forth in the town's own noise bylaws which would permit noise from 7 a.m. until 11:00 p.m. only - similar to what is permitted also in the City of Boston. According to Massachusetts state law / regulation 310 CMR 7.10 "no person owning, leasing or controlling a source of sound shall willfully, negligently, or through failure to provide necessary equipment, service, or maintenance or to take necessary precautions cause, suffer, allow, or permit unnecessary emissions from said source of sound that may cause noise." The only omissions from this law are noise from town parades, public gatherings, sporting events; emergency vehicles, including police, fire and ambulance vehicles, and domestic equipment such as lawn mowers and power saws between the hours of 7:00 A.M. and 9:00 P.M. Brookline's Town Noise By-Laws state, in ARTICLE 8.15 NOISE CONTROL: "Whereas excessive sound is a serious hazard to the public health and welfare, safety, and the quality of life; and whereas a substantial body of science and technology exists by which excessive sound may be substantially abated; and whereas the people have a right to and should be ensured an environment free from excessive sound that may jeopardize their health or welfare or safety or degrade the quality of life; now, therefore, it is the policy of the Town of Brookline to prevent excessive sound which may jeopardize the health and welfare or safety of its citizens or degrade the quality of life. This By-law shall apply to the control of all sound originating within the limits of the Town of Brookline." An example of persistent and detrimental noise: The street sweepers pass by Fuller Street and Gibbs more than two times per week, four times per month, for several hours per night, exerting more than 10 dB(A) ambient noise. This sustained exposure to extreme noise disrupts sleep patterns, which, over time, effect the good health of Brookline citizens. The noise has become a public nuisance. While the undersigned respect the need to street clean, the hours must be changed to daytime hours, as elsewhere in the state of Massachusetts, in order to accommodate the working and sleeping hours of the majority of the town and to improve their quality of life in Brookline.
