November 26th, 2014 the Clark County Counselors changed our longstanding WA State Noise Ordinance 173-60-040, and implemented a new noise ordinance enforceable only against Clark County Wineries.

We feel the commissioners acted in good faith looking out for Clark County citizens however; there are serious flaws in the practical application.

We request your help to fight this unfair noise ordinance change.

1. Wineries in Clark County are currently being unfairly discriminated against by our Clark County Counselors.

2. This change represents a 27% noise reduction below the WA State code.

3. Clark County staff was already informed by an acoustical engineer that their proposed change to 50 dBC was “unreasonable and difficult to enforce”.

4. On Dec 16th, 2014 we commissioned a study of our ambient noise level (no music & no guests). It was conducted by an impartial acoustical engineer and recorded an average score of 58 dBC. This result is 16% above the minimum Clark County Noise Ordinance of 50dBC with absolutely no music or guests.

5. It is impossible for Lucy’s and other Clark County Wineries to comply with the Clark County new ordinance of 50 dBC up to 10 pm.

6. The new ordinance only applies to Clark County Wineries yet all other Clark County businesses still remain under the prior WA State code 173-60-040.

7. The new noise ordinance discriminates against Clark County Wineries and severely cripples our ability to compete with Oregon Wineries and other wedding venues such as churches, event centers, and restaurants.

8. If allowed, this ordinance sets precedence for Clark County's Councilorsto unfairly target other Clark County small business segments.
