Motion to reopen Expunged Records, Reseal & Expunge and order correct coding to BCI

Now comes plaintiff, Tonya Sue Blakeslee of 6880 Brandywine St #37 Middletown, Ohio 45044 before the court to request that records of expungment in Case #04CRB01911 filed in Middletown Municipal Court be hereby ordered reopened and unexpunged for the period of 24 hours to allow the plaintiff time to obtain copies of records that are no longer available.

The request for these records were discussed with Mr. Bud Rossi of Middletown Municipal Court Adult Probation and referred to this process for petitioning the court. The reason for this request is that BCI has me listed with a crime under 2913.02 when I was found guilty of a petty theft which is not a felony. This has interfered with the plaintiff in securing jobs recently in the health field. The plaintiff is a Registered Nurse. If the plaintiff has copies of the records that were expunged, the plaintiff can therefore present them to show that she was not found guilty of a felony.

Plaintiff hereby requests that the records be ordered resealed and expunged after 24 hours of the court date.

Plaintiff hereby requests and moves the court for an order to BCI to have my misdeameanor listed and classified as such and removed as a felony. The ORC code should accommodate the offense and not be found under theft which constitutes a crime of $500 or more in merchandise. This offense was much less and found to be a misdemeanor and the plaintiff hereby states that she is being punished severely by BCI for their lack of proper coding. Therefore, an order is requested that BCI be ordered to properly code this misdemeanor as such and plaintiff be presented with the order as well for this request and an order be signed by the judge and sent to BCI in London, Ohio with the court order.
