Montgomery Place Community Parking Regulations and Enforcement Petition

Mont. Place Community Association's forthcoming amendments and regulations place the burden on the homeowner to monitor their parking. The regulations, though, they had been in effect in some form, do not need a change in enforcement. A community associations' purpose is to preserve, maintain, enhance, and protect. The new enforcement procedures do not work for the benefit of the homeowner, but add difficulty, stress, and unnecessary labor.

Issues with the updated parking policy include:

-The towing service has choice on whom to tow by their own determination of compliance with Association rules, without necessarily having a tow request, and will likely result in tow trucks hunting for cars throughout the neighborhood.

-The homeowner needs to have approval in registration for different vehicles parked in their own spaces. This causes extra burden, as well as issues and difficulty with guests and neighbors.

-These changes were voted on by a very small group, and ability to vote on these regulation changes was not made available to those who have conflict with work, travel or other matters preventing them from attending a community meeting. Changes of this import should be made available by a ballot or other means left on neighborhood doors, or distributed by the same means the newsletters are.

The Montgomery Place Community of homeowners request the following changes by the Montgomery Place Community Association:

-We request that the new enforcement procedures and amendments be canceled immediately.

-We request the cancellation of the mandate for new parking tags.

-We request the immediate termination of the new towing contract with SJC Towing & Recovery, LLC.

-We request that the tow truck company not be given choice and ability to tow and monitor the neighborhood by their own accord, especially without a request made by a resident, and approved by management.

-We suggest that if the responsible Association members cannot complete the duty of being moderator for towing requests, that the duty be given to a management company that will honor our stated requests.
