Molly Spillane's use of Outdoor Dining

A few things to consider here Frank: 1. I have not made any of the arguments that you so eloquently refute with both unmitigated sarcasm and condescension. In fact, I agree with you that the argument "well you live next to a bar, deal with it" is a complete non-starter and borders on being childish. 2. Your round dismissal of the opinion of anyone who hasn't "liv(ed) with it" for five years indicates to me (and others) that you're on this forum simply to voice your opinion without taking into consideration any dissenting opinion. That's not indicative of the healthy dialogue that should go on between adults who disagree. That statement is not intended to offend you in any way, just pointing out how your conduct comes across to another adult. 3. My opinion does matter. While I concede that you have a more spirited opinion on the matter because it affects you firsthand, I, too, pay taxes to the Town and last I checked the volume and tone of your arguments is not necessarily directly proportional to their validity. Your comment about having "people from Ireland" comes off more than a little xenophobic and condescending (repeated theme). 4. I never professed to be "in the know" but I do know a few things are irrefutable; the owners of Molly's will be entitled to their due process no matter what steps you take to belittle their patrons and officers on this, or any other, message board and the Town Code as it relates to noise is quite vague. Section 141-6 outlines what's considered a noise violation, and it explicitly combines both "day and night" into the verbiage. If you're so confident that Molly's is in consistent violation of this paragraph then you shouldn't have much to worry about at a zoning hearing. Unfortunately for you the law is, as I mentioned, quite vague because it involves a large measure of subjectivity and does not identify allowable decibel levels, etc. 5. Molly's is not the only establishment on Mamaroneck Ave. with a license to serve

Simply put, if the noise causes the village residents such a disturbance that they cannot sleep or function properly than Mollies does not deserve the permit, however, Mollies is a great establishment with an amazing atmosphere and great for individual and families to eat at. At night it can get noisy yes, but this is a bar and music is being played, so it is expected. In all honesty, I have been there a few times at night and it was noisy, but not so much that it would affect the town residents, so I think they deserve the permit to continue their outside dining.

Do the police get called constantly in regards to the noise late at night? If the answer is yes, than the permit shouldnt be granted and this petition is useless. If the answer is no, than the people pissing and moaning are just pissing and moaning and the permit should be granted and this petition is useless.

I close the patio every Friday & Saturday and our staff is instructed to do so as well. The only people on the back patio after 2am are the cleaning crew. Please see and hear for yourselves this weekend. Having the patio closed at 2am is not only adhered to by our security staff but it also makes our jobs much easier since we have less space to staff as a result.

Its a given on the weekend, people. Buy some earplugs, stop crying about the noise, and go to sleep.

This establishment has the right to sell overpriced drinks, over serve its patrons and play music so loud that it drives it's residential neighbors absolutely mad. Let the drunken bafoonery commence post haste!

Irrespective of what any sign says there is a comment above from one of the managers of the bar outlining when the bar patio gets closed down. I don't doubt that you're passionate about this issue as it seems you've replied to nearly every post on the message board but I do take issue, as Bret does, with the air of hypocrisy that surrounds your comments as they relate to misinformation. For you to make repeated inflammatory comments about Molly's presence within the community completely ignores fundraising efforts made by Molly Spillane's (and it's proprietors you seem quick to insult above) to benefit the very organizations that are called upon to perpetuate this senseless crusade. Molly's complied and continues to comply with laws and has made efforts to remedy the noise issues both in the past and going forward. Just as you are protected by the Town Code and other laws, they too can operate within its auspices. They should not be denied the ability to offer the best service to their clientele that their staff and property can afford. If 1am on a Tuesday is past the line in your opinion (not the Town's) then where does the line exist? 10pm? 12am? You're very clearly a creaking wheel here. It is your right and I appreciate your position, but the argument you make is not going to be best heard in an Internet forum supporting a petition for Molly's. I only request that you not be so quick to characterize the good people at Molly's as adversaries of the people of mamaroneck. You may have a personal issue, and you may share that with a handful of residents but you do not have the ability or authority to cast aspersions on behalf of the Town of Mamaroneck and all it's residents

Since it opened, Molly's has not been a good neighbor to those of us who live nearby. There are five eating establishments on the block between Molly's and Boston Post Road, and no complaints about any of them. Why? Because they are quiet and don't bother residents. Molly's is essentially a huge restaurant/banquet hall that never should have been approved in the first place and has turned out to be a gigantic nuisance. Charitable works are fine, but have nothing to do with being a considerate neighbor.

Can I borrow the ear plugs from the people that have to listen DJ REACTS Sets ?

I'm very proud of you for that , but the fact of the matter is Molly's is violating the village of mamaronecks noise ordinances on a regular basis , and deceived the local community and zoning board when they applied for their "special permit" . Molly's is surround on all 4 sides by residential buildings and in no way in an all commercial area . You can slant it any way you want but the fact of the mater is Molly's is breaking the law on a weekly basis and in no way are they a friend to residents on mamaroneck ave as they claim they are above .

My position is that anybody that doesn't live in the direct area around Molly's should have no reason to tell me what is right or wrong with this noise issue . It directly impacts hundreds of family's on a daily basis and unless you've been living with that for the last 5 years than your opinion means nothing to me and you are just people supporting a patio because you get a kick out of it once a month , most likely during the day . The people that put their eating and drinking needs over the quality of life of your neighbors just has me beyond confused with society. For me putting out misinformation I don't know how ? I was just trying to clear up for all the people that "like" Molly's on Facebook and were directed to this that they got the whole story and that the patio was not going to be bulldozed over . I was saying the late night operation of it needs to end . For the people that say you live next to a bar you should expect it .. We are supposed to be living next to a family restaurant , that's what was stated with their opening proposal . That argument holds no weight with me... It's not a handful of people who have a problem, its hundreds with at least 150 kids who live within blocks who are kept up every weekend by the blasting music and loud drunk people on the streets around Molly Spillane's. It's not just the patio, it's the music pounding from inside that by Village law has to be turned down to not disturb the neighborhood. But the police need to be called every weekend to get them to comply. There are 148 documented complaints in 2 years about noise, fights and disorderly conduct at Molly Spillane's and this business is NOT being a good neighbor to this community.

It is amusing that you would open with how Molly Spillane's is misinforming people while simultaneously getting all of your facts wrong. For starters, the patio area is not open until 3AM, not on any day. Secondly, in another comment, you mentioned the DJ. The DJ has absolutely nothing to do with the patio; he is inside. So, right here, we know this is nothing more than a witch-hunt. You are just taking your one shot - regardless of whether or not it makes sense (which it doesn't, by the way, and judging by your spelling/grammar, logic doesn't seem a high priority to you) - by attacking the outdoor area. But, congratulations! Congrats on achieving so much in life that the imaginary noise issues are the biggest problem you have. As a long-time customer of Molly's, I really hope your cunning plan falls through. Half because I love the establishment and half because I am positively sickened by people like you.

Wow really? So everyone who has an issue with the noise is an obese internet addict who hates fun? Wow what a great argument -- that will really get people on your side. And I call shenanigans on the no complaints claim. I actually WALKED OVER to the restaurant in person a few years ago when the noise was out of control on a Sunday night when my son had to go to school the next day, and politely asked the person on duty that it please be lowered, which it eventually was. Guess you just weren't working that day?

For the dj comment obviously my humor is to low brow for a person of your Stature .
