As residents of Millponds, paying monthly HOA fees, it's has come to our attention that the Association Board will not be opening the pool this year (for the second summer in a row) as a response to COVID-19. Along with the pool, the playground and courts have also been closed up. Last year, no money was refunded that was supposed to go toward access to these facilities, and this year, there is no indication that that will be done either.
We, as HOA fee-paying residents hereby petition the board to do the following:
1) open the pool in accordance with CDC guidelines for 500-person limit and distancing guidelines (none of which would apply to vaccinated residents, who can show proof of vaccination), and provide every resident a legal waiver so any COVID-like infection cannot be grounds for a lawsuit against the HOA to sign prior to getting their pool passes (similarly to how they required chimney cleanings, etc.)
2) same with playground and courts - open, signed waiver, exclusion for anyone who has been vaccinated
3) if the above cannot be done, a full refund of the entire year of the portion of HOA fees that was designated for access/maintenance of those three facilities.
If none of these requests are going to be met, residents will withhold their HOA fees as contractually obligated, until the association deems it necessary to fulfill THEIR end of the contractual agreement with residents as well.
