Anthony "Tony" Stewart is an adult with an intellectual disability and end-stage renal failure who is currently incarcerated in Virginia. This condition requires consistent medical care and attention, yet Tony is experiencing ongoing medical neglect in prison, which is threatening his life. His family's pleas, along with advocacy groups writing letters to prison officials, have been met with repeated failures to provide consistent life saving treatment that medical professionals recommend.

About Tony

While Tony is a social, kind person, he has always struggled cognitively. He was in special education from a young age due to learning disabilities. Then, when Tony was only 14, he was in a tragic accident that resulted in a severe traumatic brain injury. He was in the hospital for nearly a YEAR learning to walk, talk, and complete basic self care activities. From then on, Tony struggled with mental health issues related to his brain injury and began self-medicating with drugs. Tony's Sentence for Nonviolent Drug Offense

Tony was given a disproportionate 40+ year sentence for a nonviolent, drug offense. The prosecutorial system made concerted effort to send Tony to prison. While he was repeatedly found to be Incompetent and unrestorable by state-appointed psychiatrists, the prosecution persisted with evaluations until he was found "competent" to stand trial through a phone-call based evaluation - even though he was never given treatment or mental health services after being found previously unrestorable. In fact, Tony's prosecution and sentencing weighed on the conscience of the esteemed psychiatrists who found him incompetent and unrestorable that they independently and without knowledge of Tony's family filed a letter to Governor Youngkin advocating for clemency.

Medical Clemency/Medical Parole NOW

In Tony's current situation, his health is deteriorating rapidly due to inconsistencies in medical care, particularly concerning the care of his renal port. His inability to care for himself adequately is compounded by his disabilities, leaving him vulnerable and in desperate need of proper medical attention that he is not receiving.

This situation is not just a legal oversight; it is a profound human rights issue. Denying essential medical care to an individual with Tony's conditions violates principles of dignity and humane treatment. He requires immediate medical parole to ensure his life is not unjustly shortened due to systemic neglect. Releasing Tony on medical parole would allow him to receive the comprehensive care necessary outside the constraints of the prison system, where his health needs can be better managed by Hospice and his family can have intimate involvement in his care.

This action would not only uphold the integrity of our justice system but also affirm our shared humanity. Support for Tony would also be a step forward for others like Tony who are encountering medical neglect in the prison system and do not have relentlessly dedicated family to send letter after letter to push back against medical neglect.
