Summary: A petition to the Missouri General Assembly to account for inequalities in alcohol regulation that discriminate against adult citizens between the ages of eighteen and twenty. The petition request that the Missouri General Assembly replace the word twenty-one and replace with eighteen in all alcohol related statues. ___________________________________________________ To the honorable Speaker of the Missouri House of Representatives, President Pro Tem of the Missouri Senate, and all Missouri Legislatures: We the undersigned citizens of the State of Missouri and the United States of America do respectfully request that our petition of grievances be received by the Missouri General Assembly for consideration. Whereas: The Missouri Constitution Article 1 Section 9 provides: �That the people have the right peaceably to assemble for their common good, and to apply to those invested with the powers of government for redress of grievances by petition or remonstrance, and Whereas: Missouri Statues 311.055, 311.300, 311.310, 311.320, 311.325, 311.326, 311.328, 311.329, 311.462, 311.480, and 311.710 effectively deprive Missouri citizens between the ages of eighteen and twenty from the enjoyment of their own gains, life, liberty, free association, the pursuit of happiness, and equality by excluding them from purchasing, selling, consuming, and manufacturing alcohol beverages, and Whereas: Missouri Statues 311.055, 311.300, 311.310, 311.320, 311.325, 311.326, 311.328, 311.329, 311.462, 311.480, and 311.710 supports the concept that citizens between the ages of eighteen and twenty are inferior, or to say the least should be treated unequal in comparison to other citizens above the age of twenty one, and Whereas: Missouri citizens, at the age of eighteen, are considered adults with full citizenship rights associated with every aspect of society, save those liberties mentioned in the second and third whereas, and Whereas: The Missouri Constitution Article 1 Section 2 provides: �That all constitutional government is intended to promote the general welfare of the people; that all persons have a natural right to life, liberty, the pursuit of happiness and the enjoyment of the gains of their own industry; that all persons are created equal and are entitled to equal rights and opportunity under the law; that to give security to these things is the principal office of government, and that when government does not confer this security, it fails in its chief design,� and Whereas: The United States Constitution Amendment 14 Section 1 provides: �All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws,� and Whereas: We petitioners believe that the Missouri Statues 311.055, 311.300, 311.310, 311.320, 311.325, 311.326, 311.328, 311.329, 311.462, 311.480, and 311.710 stand in violation of Article 1 Section 2 of the Missouri Constitution, and Whereas: We petitioners believe that the Missouri Statues 311.055, 311.300, 311.310, 311.320, 311.325, 311.326, 311.328, 311.329, 311.462, 311.480, and 311.710 stand in violation of the 14 Amendment (Section 1) of the United States Constitution, Whereas: We petitioners believe that the Missouri Statues 311.055, 311.300, 311.310, 311.320, 311.325, 311.326, 311.328, 311.329, 311.462, 311.480, and 311.710 should be modified for reasons mentioned in the second through eighth whereas, and Whereas: it is the duty of Missouri Legislatures to uphold the Missouri constitution, therefore we Request: That this petition be read in both the Missouri House and Senate. Request: That the Missouri legislature should account by means of resolution, from both assemblies, for the grievances occurred by continuing to uphold Missouri Statues 311.055, 311.300, 311.310, 311.320, 311.325, 311.326, 311.328, 311.329, 311.462, 311.480, and 311.710 without modification. Such resolutions may be delivered to Missouri Citizens for Liberty Corporation, the sponsor of this petition. Request: That a public hearing should be held to allow government officials and citizens the opportunity to discuss the grievances of this petition. We further request that petitioners be informed of such hearing the moment it is scheduled. Acknowledgment to Missouri Citizens for Liberty Corporation shall be sufficient notification. Request: Missouri Statues 311.055, 311.300, 311.310, 311.320, 311.325, 311.326, 311.328, 311.329, 311.462, 311.480, and 311.710 be modified by removing every instance of �twenty-one� and replace with �eighteen.� Request: That all changes to Missouri Statues 311.055, 311.300, 311.310, 311.320, 311.325, 311.326, 311.328, 311.329, 311.462, 311.480, and 311.710 be approved by a public vote in either a general or mid-term election. Request: That Missouri Citizens for Liberty Corporation be given the opportunity to address the Missouri House of Representatives and Senate should this petition be read into the record for either assembly.
