Dear Mr. Eichenlaub, I am the friend/family member of federal prisoner Mark Jordan, currently imprisoned in the Special Housing Unit (SHU) of the U.S. Penitentiary-Lee County, Virginia. Mark was released from the ADX Control Unit in May 2010 after eleven (11) years of solitary confinement and successfully completing the Control Unit Program. He was in the USP-Lee general prison population for less than forty (40) days when, on July 10, 2010, he attempted to prevent a prisoner-on-prisoner stabbing on the prison yard by placing a foot on the hand of another prisoner who was wielding a weapon or "shank" and trying to stab a third. Mark did no more than attempt to break up a potentially deadly altercation between the two prisoners.In reward for this effort, Mark was placed in segregation and charged with serious assault. At the subsequent disciplinary hearing, the hearing officer found Mark guilty of the lesser charge of non-serious assault on the premise that regardless of his intentions the placing of his foot on the other's arm amounted to an "unwanted touching" which is an assault under BOP policy. After then Warden Terry O'Brien rejected Associate Warden R. Cosgro and SIA R. Pitts' recommendation to refer Mark for placement in a Special Management Unit (SMU), on August 20, 2010, Mark was approved for a 330 transfer from separatee with a recommendation of USP Canaan. However, on October 5, 2010, after Warden O'Brien was replaced, the Designation and Sentence Computation Center in Grand Prairie, Texas deferred the transfer request and directed Mark's Unit Team to submit a SMU referral packet for regional review. Respectfully, as a relative or friend of Mark's and a citizen of the United States, I find the BOP's handling of this matter and his continuing maltreatment absolutely atrocious and horrifyingly cruel, not to mention wholly arbitrary and capricious. In addition, there have been no contact visits for far to many years, one phone call a month that has been a severe hardship on family and friends alike. He has already a history of eleven (11) years in solitary confinement, and now this. It just isn't fair or in the best interest of justice. It is my fervent hope that you will see fit to intervene in this matter and ensure Mark's twelve-year nightmare of solitary and restricted confinement comes to an end.
