What looks more inoffensive than a baby sleeping in an organic cotton mermaid knotted gown?

However, on March 28th, the US Consumer Product Safety Commission has determined that the ''Knotted Gown'' does not respect the ''Standard for the Flammability of Children's Sleepwear'' and therefore it is prohibited in the U.S.

Regulations stipulate that the knotted gown, intended for children from 0-9 months is not considered as «sleepwear». It can therefore be made of 100% cotton and pass the inflammability test for day clothing. That makes sense because sleepwear for children under the age of 9 months is not subject to the requirements because babies have limited mobility, thus they are not expected to be unsupervised for long, and are not likely to catch a sleeve or pant cuff on an open flame.

(…) However, one-piece garment that exceeds 25.75 inches in length, which excludes it from the definition of an infant garment in the Standard (…) your garment (electrik Kidz knotted gown) measured 34.5 inches in length and, therefore the referenced sample is not an infant garment and must comply with the Standard. Children's sleepwear garment made of 100% cotton will not pass the Standard for nightwear.’

Since our gown exceeds the maximum length of 25.75'', it is excluded from the definition of an infant garment in the Standard and it must submit to more strict tests on inflammability. However, our products only fit for children from 0 to 6 months. Children under the age of 6 months should not be subject to the requirements because babies have limited mobility, they are not expected to be unsupervised for long periods of time, and are not likely to catch a sleeve or pant cuff on an open flame on their own.

As you can see, the product 'Knotted Gown' is located in a gray area of this regulation and there is no reason to consider it 'not for infants' since the sizing is only for babies from 0 to 6 Months.

'Knotted Gown' has to be long enough to allow parents to knot it at the bottom for an easy diaper changing.

We are asking the Commission to amend the regulation and extend the maximum length of children's sleepwear or exclude the knotted gown from 'children's sleepwear' category in order to make the knotted gown permitted in the US, like in any other country on the planet.
