To the Board of Managers for Windows on 123 Condominium:

The unit owners of Windows on 123 are a community of friends, colleagues and neighbors. Owners share a common goal in doing what is in the reasonable best interest of the building – a place most of us and our families call home – and want interactions with other owners to be friendly and respectful, so that our community can flourish.

We have received and reviewed your two emails from this week, each of which has been deeply concerning to many of us. They first suggest that the Bylaws are not to be read plainly and then that they can simply be ignored. The emails tell the owners that they are not entitled to transparency on how or where their money is being spent. They remove open dialogue in favor of Board directives with owners BCC’d. The first email attempts to isolate and admonish any unit owner who raises any questions, while the second of the two unilaterally revokes the owners’ rights under the Bylaws to vote on the Board’s proposed spending.

Those of us signed below do not believe this is the way a Board – our Board – should behave or treat the owners of the building. Rather, we believe that the Board is to be governed by the Bylaws at all times. That owners’ rights under the Bylaws are to be upheld at all times. That open communication between all owners and the Board should be encouraged and facilitated. And that we have a reasonable expectation of transparency and accountability from the Board and its vendors at all times.

Accordingly, we insist that the Board promptly:

  1. provide detailed quotes of all contractors, engineers, and architects proposed and/or contracted by the Board on our behalf;
  2. call for and adhere to a vote by the owners on the proposed spending;
  3. facilitate open communication amongst owners; and
  4. at all times adhere to plain text of the Bylaws.

If numbers 1 and 2 are not agreed to immediately and carried out promptly, we and those who will join us in the interim are prepared to remove members of the Board.

We understand that serving on the Board is a volunteer position that can take up a good deal of time and, at times, be thankless. We are grateful for the time you have invested in the Board. We believe the building does need repair and are aligned in our interest to get it done. However, we can no longer stand by and allow our rights and reasonable expectations to be trampled.
