New York State Supreme Court Justice John L. Michalski’s ruling exempts Gorczynski from a state age restriction. We, the undersigned parents, teachers, coaches, student-athletes and friends of all who wish to compete in XC, strongly encourage the NYS Education Department to reverse their ruling on allowing David to compete with his fellow Orchard Park teammates in XC for the 2013 season. David does not possess a elite ability to influence the outcome of any races he competes in because of his disability but he is a key member of his XC team as his teammates encourage, cheer and admire his competitiveness and be key member of the team. Given the circumstances, an exception should be made to allow David to complete his senior year as a member of the Orchard Park Cross Country team.
