Final supporters
This matter is urgent. The State of Kansas and Johnson County are incorrectly defining our boutique fitness studios as large-scale gyms, excluding us from the Phase 1 Reopening set to be determined tomorrow, April 30, 2020. There are a variety of problems with this determination. Most importantly, it is not our responsibility to prove that we cannot reopen safely. It is the state that has to prove that we cannot open safely. This may need to be determined in the U.S. District Court. It is our hope that the State of Kansas and Johnson County will see that they have NOT given deference to the business owners, like us, and individuals with respect to our fundamental civil rights. This is required by the U.S. Constitution and upheld by the Supreme Court.
We are prepared to open safely on May 4, 2020. Social distancing requirements will be met and exceeded. Sanitation requirements will be exceeded on a patron per space utilized basis. Limitations for patronage admittance will be based upon limited occupancy per square foot of floor space. This formula would be no more than 1 person per 150 square feet of floor space. Classes will staggered so that patrons can come and leave without interaction or contact of the next small group or class. Between the staggering, staff will clean and disinfect each space for a minimum of 10 minutes to eliminate possible contagions. This exceeds most standards currently in place with "essential' businesses allowed to operate.

Small fitness boutiques are essential to health and well being of our communities. They are almost all locally owned small companies and have get limited class sizes with the ability to manage social distancing, sanitizing and participants. Please allow them to open now so they can survive.
This is a small business with maximum capacity of 12 people at one time. As. Nurse and attorney, I have witnessed the fact that the owners practice excellent sanitation even prior to the COVID-19 pandemic.
Classifying smaller, boutique fitness facilities that have less than 10 people in a given building/class, with a larger facility that can have >100 in a facility at one time, is unfair. Please allow smaller facilities to open in Phase I.
The health, wealth and performance of our economy is inextricably tied to the health and well-being of our community. One-size does not fit all, in categorically grouping boutique fitness businesses with large-scale gyms in our metro.
I support this stance as a small business owner and health professional. If the State of Kansas is concerned with the safety of such businesses, they should be vetted individually (similar to a health inspector inspecting a restaurant/food service).
Open up and take back our freedom! No more govt overreach. No more stomping on our constitution.

Body lab has already proven they know how to handle social distancing. They functioned for 2 weeks with half as many attendees so that space was between each reformer. They already limit the number of people present for a class. Let them open please!
