Mr. Robert Sylvester Kelly poses no threat to the community. He deserves bail to sit down with his lawyers to defend himself. It's impossible to do that in jail during a pandemic.

Pretrial detention of suspects directly impacts the presumption of innocence. The cornerstone of the justice system is that no one will be punished without the benefit of due process. Incarceration before trial, when the outcome of the case is yet to be determined, cuts against this principle. The Founders were aware of the dangers inherent in indiscriminate imprisonment such as in Mr. Kelly's current situation which is one of the main reasons behind the inclusion of the Eight Amendment in the Bill of Rights, prohibiting excessive bail. Historically, the laws limiting pretrial detention were enacted to change the focus from personal to penal purposes, thus remedying the abuses of earlier English monarchs who used jail before trial as a form of punishment.
In Mr. Kelly's case, it appears that he is being punished and his team of lawyers for some "unknown" reason are ill equipped to handle such a constitutional challenge. Mr. Leonard's argument was weak an unimpressive for a federal criminal defense lawyer. The question is why? This man should at the very least, he should be released on bail- under house arrest until he goes to trial.

Due process balances the power of law of the land and protects the individual person from it. There are Constitutional protections that Mr. Kelly has been denied and that's very disheartening to watch a man "only accused of crimes but never convicted" suffer.
