Jose Guerena, 26, was shot and killed in his home by the Pima County Sheriff Department’s SWAT Team on May 5, 2011 during a purported attempt to serve a search warrant of highly dubious legal merit.  The purpose of this petition is to request that Arizona Attorney General Tom Horne conduct an independent investigation of all the issues surrounding this gross miscarriage of justice and the literal murder by SWAT of husband, father and former US Marine, Jose Guerena.

Jose was an exemplary young man.  As a marine he served two tours of duty in Iraq.  He worked 12-hour-long graveyard shifts at a local copper mine to support his family.  He had no criminal record and there was nothing illegal in his home although that has not stopped PCSD from smearing him posthumously.

The warrant to search his home was spurious according to an independent law enforcement analysis.  The manner in which it was served was the ultimate denial of due process.  After Jose was shot more than 20 times within seconds of SWAT busting the door open he was denied potentially life saving medical care as he died on the floor in his home.

Pima County has cleared itself of all wrong doing but the facts surrounding this case  suggest and entirely different conclusion and cry out for an independent investigation.

The signers of this petition ask Mr. Horne to launch an investigation immediately.  We also ask Governor Jan Brewer to take a personal interest in seeing that justice is served.
