I am very opposed to public access through the marina events. It jeopardizes my privacy and is a huge detriment to the safety of the community

I had my golf cart at the marina and it was stolen, Buy an individual attending a wedding. The person was stopped at the front gate .

Already made my comments. But..THIS CANNOT HAPPEN. It will definitely effect our resale and property values.

The reason we bought in JL was because it was a gated community with 24/7 security. To allow the general public access into our community is just the beginning of problems and major headaches.
I vehemently am opposed to this action.

These public events in a private, gated community HAVE GOT TO GO!! They are a menace to my privacy, security and property values, not to mention my health during this pandemic, and this is NOT what I signed on for when I purchased property in Jonathan's Landing.

This is a private gated community and I really don’t appreciate the general public just coming in partying and leaving their mess. I see them going past my house slowly looking around end it makes me nervous as a senior citizen

The burden of proof must strictly be imposed upon SMI to establish by clear and convincing evidence why it waited until now before seeking any change of the conditions of operation it agreed to at the inception of the relationship. Otherwise it is barred by the doctrines of equitable estoppel and laches from it agreed to from the outset did not seek an amendment years ago to the original limitations agreed upon SMI and its predecessors. zoning regulations affected the marina. The marina must prove by clear and convincing evidence that there has been an unforeseen and unanticipated change in circumstances ( not self created) which now warrant or legally justify any modification or relaxation of the conditions of operation which were agreed to from the outset of the relationship with JL.
Under no circumstances was it ever stated or shown by SMI that the original intent of the parties was to permit the general public access and use of the marina and the bar/restaurant. It was always intended to be an adjoining benefit for the residents of JL . That is why it was allowed to be a private yacht club not opened to the public for parties , social events, and similar purposes. It seems now that the Jupiter Zoning Board is seeking to shift the burden of proof onto JL to convince the board that the modification must be denied. That is contrary to law and is unsustainable as a matter of law.
