 Depuis le mois de Mai 2010, le Ministère des Affaires Etrangères (MAE) refuse de donner des documents de voyage à mes enfants Jay et Nikhil (nés le 26 Avril 2010 à Mumbai, INDE) pour qu'ils puissent rentrer en France avec leur père.

J'ai assigné le Procureur de Nantes qui a refusé la transcription des actes de naissance Indien a comparaitre devant le TGI de Nantes pour obtenir ces transcriptions des actes Indiens, et donc la reconnaissance que Jay et Nikhil sont bien Français, comme leur père, mais cette audience ne peut avoir lieu avant le 3 février 2011, avec une décision attendue entre 4 et 8 semaines après l'audience.

Sans attendre cette décision, le MAE a la possibilité de donner des documents de voyage (Laisser-passer ou passeport temporaire) pour permettre aux enfants de rentrer en France avec leur père, puisque leur mère, indienne, m'a confié leur garde. Plusieurs avocats m'ont indiqué que cela est parfaitement possible.

Quelles que soient les conditions de leur naissance, (ce qui relève strictement de notre vie privée), Jay et Nikhil ont les mêmes droits que les autres bébés (droit à une nationalité, à vivre en famille, etc...). L'état français (puisque leur père est français) est responsable du respect de ces droits élémentaires...

En signant cette pétition, vous soutenez notre demande de documents de voyage (Laissez-Passer ou passeport temporaire) pour que Jay et Nikhil puissent rentrer en France dans leur famille. Ceci ne remet absolument pas en cause l'action judiciaire qui est menée pour la transcription des actes de naissances Indiens afin que Jay et Nikhil soient Francais, comme leur père.

Adrien Jay and Romain Nikhil were born in Mumbai April 26th, 2010.
Since May 11th we ask for the documents to travel to France (temporary passport or Laissez-passer).
These papers are refused by the French Ministry of Foreign Affairs, and consequently they cannot leave the Indian Territory.

Everything has been done according to the French law for the recognition of paternity and to the Indian law (Indian Birth Certificates, with my name as the father have been validated by the Indian authorities with Apostille stamp).

I am their father, DNA test can prove it if necessary (but in France, doing DNA test is illegal, unless a judge ask for it !!).
The judicial appeals are naturally in progress, but it is going to take several months (minimum until Mars 2011), and after 7 months in India, Jay and Nikhil need to find finally a stable life in their familly in France, near their parents, grand-parents and friends.

We ask simply for the strict application of the described rules for the delivery of these temporary travel documents (temporary passport) so that Adrien and Romain could leave with their family quickly to France.
The blocking by the Ministry of Foreign Affairs is unacceptable and violates the most elementary rights of the children such as described in the International Convention on the Rights of the Child (http://www2.ohchr.org/english/law/crc.htm).

You can help us by manifesting your indignation concerning Adrien (Jay) and Romain (Nikhil) situation, by calling the Foreign office (00 33 1 43 17 84 48 or 00 33 1 43 17 91 81 or 00 33 1 43 17 53 53) and asking to speak to the “Sous-directeur de l'administration des Français”.
