Reason:

According to the European Commissioner there is no proof that people are getting affected by embassies breaching the freedom of movement treaty for not issuing visas to non-eu family members of EU citizen. That is why we need to sign this petition to show them that THERE ARE PEOPLE who are getting affected.

Here is what Europa advice center has written to us:

"it is not open to the EU to open proceedings for infringement against the Member States concerned unless it is evident that a significant number of individuals have been similarly affected. We Want:

EC to investigate non-compliance by EU embassies around the world in accordance of EU Directive 2004/38/EC freedom of movement for non-EU family members of EU citizens

Here is what EU embassies are doing:

-Visa rejections to non-EU family members of EU citizen
-Requiring ALL documents to be presented when applying for visa as a regular applicant
-Asking fees
-Not issuing visas
-Requiring travel insurance
-Requiring hotel booking
-Requiring bank statement
-Giving excuses to waste applicant's time
-Failure to check all provided documents
-Improper visa application administration system
-Lacking direct contact with the embassy(employing visa application service such as Gerry's visa service VFS, which effectively hinders ability to contact the embassy regarding their application)
-Using expensive paid phone helpline systems
-Employing uninformed staff who has no knowledge of the EU treaty for non-eu family members
-Lengthy delays in visa processing
-Rejecting the application without enquiring further information

Who can sign:

Please sign this petition if this problem is affecting you or your family member. EACH family member must sign this petition individually. For example if there are five members of your family who is getting affected then all five members should sign this petition. Friends of affected persons may sign this petition too.

The European Commission keeps claiming they lack proof of a pattern but these horror stories from embassies across the globe tell a different story. They are ignoring the reality of families being torn apart by bureaucrats who think they are above the law. We are documenting every single violation to shove right in their faces until they can no longer pretend this is not happening.

We have tried to apply for a Schengen visa through Bulgaria's embassy in Athens, under the EU directive and they refused to accept the application without hotel bookings and so on (we were asked to apply for a normal visa and told that they as an embassy are the lawmakers, not the EU) . We also applied to France under the directive also but we were refused the visa citing that there is a risk of migration purposes...

We were refused a visa from the Spanish embassy in Tunisia, refusing to accept our marriage certificate! They were very rude and unhelpful, knowing the rules but ignoring them anyway!

Spanish consulate in Manila impossible to deal with ,continue to request the Philippine marriage certificate be registered in England. Now they demand proof of having been living with your wife in the Philippines for 12 months before they will accept the Schengen visa application.

embassies in Pakistan refuse to issue visas under Directive 2004/38/EC for non-eu family members.

Holland took over three months to process my visa and in the end I had to cancel it. it was for exercising treaty rights and free movement and the visa was for my wife
