This petition is a demand by registered voters of Howard Township to "the board of township trustees of the township or the board of county commissioners" of this county to allow competitive retail electricity service or retail electricity loads or provide electricity customers an opt-out choice with a list of providers, "respectively, within the municipal corporation, township, or unincorporated area of the county" and for which there is no choice of supplier or membership opportunity.

"(D) No legislative authority or board, pursuant to an ordinance or resolution under divisions (A) and (B) of this section, shall aggregate any retail ... load located within its jurisdiction unless it in advance clearly discloses to the person whose retail ... is to be so aggregated that the person will be enrolled automatically in the aggregation and will remain so enrolled unless the person affirmatively elects by a stated procedure not to be so enrolled. The disclosure shall state prominently the rates, charges, and other terms and conditions of enrollment. The stated procedure shall allow any person enrolled in the aggregation the opportunity to opt out of the aggregation every two years, without paying a switching fee..."
