To Bayou Vista City Council It is beyond my comprehension that a board of Alderman would show up completely uniformed on the issue of palapa which is the Spanish word for gazebo. Not one of you seemed to be informed on what these were, or that we have code in place to prevent them. Our Attorney once again did not do their job in protecting the council or the citizen of Bayou Vista in saying if we did not have a code preventing them then we must give permit and allow them as they did not look up current code, same can be said for the Building inspector for the city of Bayou Vista. If the Building Inspector or the Mayor or Mayor Pro Tem did not receive a WIP8 from Texas Windstorm on these roofs then they could not have signed off on the structures if he did he is out of the Bayou Vista Codes. The Roof line now exceed the allowable roof line for boathouses which again if the Building Inspector, Mayor or Mayor Pro- Tem allowed them to be built then they are out of Bayou Vista codes. (see below) It was my understanding that all variance had to be approved by the City Council neither of these were brought before council for approval so again they are out of Code. The persons or person that allowed this structure to be built should be held accountable!, and we as citizen are requesting that this Council take action to hold them accountable. Sec. 3.906. Permits and Fees (a) Requirements (1) Require two (2) sets of plans, two (2) sets of specifications, and two (2) copies of a survey and ground elevation by a registered surveyor. These items must be engineered for the specific property on which the building is to be constructed. Prior to occupancy of the building, the owner of said building or the builder or contractor must provide an elevation certificate indicating the base floor level of the completed building. (2) All buildings to be built to meet or exceed the International Building Code, International Fire Prevention Code, International Plumbing Code, International Gas Code, International Technical Code, International Electric Code, and Village of Bayou Vista requirements (See Article 3.900 - Sec. 3.906.1 through 3.906.6) (Ord. No. 01-05, 03-01-05) These are Definitions were taken from Chapter 3 Building and Construction in Bayou Vista. (3) Shed. As used in this article shall mean any small structure for storage or shelter. (4) Structure. As used in this article shall mean anything constructed or erected, which requires location on the ground or attached to something having location on the ground. (5) Building. As used in this article shall mean any structure having a roof supported by columns or walls, and designed or intended for the shelter, support, enclosure or protection of persons, animals or chattels. (Ord. No. 94-02, § 1, 11-1-1994) (iii) Boat Lifts – Piers - Overhead Walkways (aa) All construction shall meet or exceed the Deed restrictions of the Section of Bayou Vista involved and additionally meet all the conditions set forth in the International Building Code. (bb) The length of the pier or dock must not exceed past the five (5) foot set back building line on either side of the property where the pier or dock is to be constructed. (Ordinance No. 01-02, 01-28-02, Ord. No. 01-05, 03-01-05, Ord. No. 03-05, 5-3-05) (cc) Lumber Grade and Type (AA) Lumber used which is above normal high tide level, shall be at minimum Grade No. 2, press and treated to 40 P.S.I. (BB) All piling shall be 8' x 8' and a minimum of 24' in length driven to a point of refusal. (CC) Lumber used which will be below normal high tide level shall be of 2.5 treated type (CCA Type C. Saltwater Treatment). (dd) Minimum Acceptable Design Requirements (AA)Maximum Heights (1) The maximum height shall not exceed the elevation of the floor of the base floor level it adjoins. (The maximum HEIGHT NOW EXCEEDS BASE FLOOR LEVEL!!! (2) Railings used shall be of open design with a minimum of four inches (4 inches) on center spacing and not to extend more than four feet (48 inches) above the top of the boatlift. (BB) Roof, Sides, and Ends (1) Closed sides or ends are prohibited. (2) Granulated roll roofing, hot mop, or cold mop types may be used on the top of flat roofs providing it does not visibly extend below the top. (3) Mansard type roofs may be used providing they meet or exceed the International Building Code and the Texas Windstorm Resistance Code, and do not extend down more than four feet (48 inches). (Ord. No. 01-05, 03-01-05) NEITHER ROOF MEETS TEXAS WIND STORM (CC) Length (1) No structure (boathouse) may be constructed which restricts ingress and egress water access to any adjoining lot. The structure cannot be built any closer than 12’ from either side of an adjoining property line. (Ord. No. 03-05, 5-03-05). (2) (DD) Width (1) No structure may extend more than twelve feet (144 inches) from the waterside of the bulkhead into the canal except as herein provided. (2) Maximum width shall not include roof overhang providing it does not extend more than two (2) feet out from the outermost side of the outside pilings. (3) Maximum allowable width shall include walkways or any other projections. (ee) Overhead Connecting Walkways (AA) If overhead connecting walkways or decks are permitted by the Deed restrictions, they shall be designed by a registered engineer to meet or exceed all provisions of the International Building Code. (Ord. No. 09-03, § 1, 9-2-03, (Ord. No. 01-05, 03-01-05) (BB) Height of deck and railings shall be the same as for boatlifts. (ff) Location (AA) No boatlift shall be constructed adjacent to any lot not having a residence thereon. (BB) Ingress and egress shall be from the subject property only. Sec. 3.906.2 Framing: 1. Floor joists shall be a minimum of 2" x 8" except for porches which shall be a minimum of 2" x 6". 2. Ceiling joists and rafters shall be a minimum of 2' x 6". 3. Wall Studs shall be spaced on not more than 16" centers. 4. Roof shall be Seal Tab Composition, Pitch and Gravel or approved equivalent shall be used for flat areas. All composition roofs must have 6 nails per shingle. Roof decking shall be a minimum of 5/8". No wooden shingles or shakes shall be used. 5. All siding shall be solid wood or plywood minimum 5/8" on living area of structure. Siding application in all other areas of structure subject to approval of Building Inspector. ½” plywood base shall be applied under vinyl or metal siding subject to approval by Building Inspector. Sec. 3.904.1. Variance Prerequisite (a) Prerequisites for granting variances: (1) Variances shall only be issued upon a determination that the variance is the minimum necessary. (2) Variances shall only be issued upon: (i) Showing a good and sufficient cause, (ii) a determination that failure to grant the variance would result in exceptional hardship to the applicant, and (iii) a determination that the granting of a variance will not result in increased flood heights, additional threats to public safety, extraordinary public expense, create nuisances, cause fraud on or victimization of the public.
