
Heritage Point HOA Transfer

We, the undersigned residents of the Heritage Point community in Henry County, GA respectfully request Lennar Georgia, Inc. to begin the process of transitioning Home Owner Association (HOA) control to the homeowners.
As residents of Heritage Point, we are deeply invested in the quality, value, and future of our neighborhood. However, we have experienced ongoing and serious concerns with the performance of Community Management Associates, Inc. (CMA), the HOA management company acting on Lennar’s behalf. These issues include:
- Lack of transparency and communication: Homeowners have not received timely updates regarding important decisions or HOA operations through neighborhood-wide emails, leaving residents uninformed and disconnected from important matters.
- Delayed maintenance and unresolved issues: Neighborhood concerns such as common area upkeep, are often ignored or significantly delayed. Necessary additions and essential repairs take far too long to address, often with no clear timeline or communication.
- Unprofessional behavior: Our assigned representative, Jeffrey Gaines, has failed to respond to several formal inquiries and continues to ignore requests from multiple homeowners. Many have also reported being spoken to in a rude and dismissive manner, further eroding trust and confidence in the management team.
These ongoing problems have led to a breakdown in trust between the homeowners and CMA and have negatively impacted the livability and property values in our community.
Our community deserves better. Therefore, we respectfully request a transition of HOA control to the homeowners, in accordance with Section 10.5(b) of the governing documents.
10.5 Termination of Rights of Declarant. “The rights of Declarant to take, approve or consent to actions under this Declaration, the Articles of Incorporation and the Bylaws shall cease and be of no further force and effect upon the earlier of (a) the date that the Declarant no longer owns any property in the Community and no longer owns any additional property which may be added to the Community as provided herein and a certificate of occupancy has been issued for the residential dwelling located on each Lot in the Community; or (b) the date of recording by Declarant in the Henry County, Georgia land records of a written instrument terminating all of Declarant’s rights hereunder.”
Empowering residents to lead will allow for more responsive, transparent, and community-driven management that reflects the true needs and priorities of those who live here. Homeowner-led HOAs are typically more attentive to the unique needs of the community, prioritizing transparency and accountability in their decision-making. Because residents are personally invested in the neighborhood, they make choices with long-term value and sustainability in mind. This type of local leadership also fosters a stronger sense of trust and shared responsibility, helping to build a more connected, empowered, and thriving community.
We are ready and willing to take an active role in ensuring Heritage Point thrives — but we cannot do so without appropriate representation and involvement in how our community is managed.
