We, the undersigned family members, community members and concerned residents, respectfully call for Ireesha Francis to be released on bail pending the finalisation of the criminal proceedings against her.

Ireesha stands accused of murder after the tragic death of her one day old baby, Faith, whose body was found in a stormwater drain in Lotus River. This matter has caused pain across the community. Baby Faith’s life deserves dignity, truth and justice.

At the same time, Ireesha remains an accused person, not a convicted person. We believe that this tragedy was connected to abuse, emotional trauma and a severe psychological break after childbirth. This incident does not reflect the person they know.

South African law allows an accused person to be released on bail before conviction where the interests of justice permit. Section 35(1)(f) of the Constitution gives every arrested person the right to be released from detention if the interests of justice permit, subject to reasonable conditions. Section 60 of the Criminal Procedure Act 51 of 1977 also allows bail where the court is satisfied that the interests of justice permit release.

We respectfully ask the court and prosecution to consider bail with strict conditions, including regular reporting to SAPS, a fixed residential address, attendance at all court dates, no interference with witnesses and access to medical and psychological assessment.

Bail is not an acquittal. It allows Ireesha to prepare her defence while remaining under the authority of the court.

We ask for justice for Baby Faith.

We ask for due process for Ireesha.

We ask for a humane and lawful decision.
