Grandparents rights in Florida need to go a long way in Florida. We did not realize this was an issue until we lost our daughter Brittany Thornton in a car accident in July 2016. We had our grandson Carson about 10 out of 14 days before she passed. Since then his father James Fenerty refuses to let us have any visitation or contact with Carson. He refuses visitation because we never had a good relationship with James. Not because he thinks it is in Carson's best interest. James and Brittany were never married and before she passed James was never really that involved in his son's life. After talking to attorney's and checking out the law for grandparent's rights, we found out that grandparents don't have any rights in Florida. After reading the law, the way we understand it, we figured out that only one word could change the law drastically. The law states that grandparents could have rights if one parent was deceased And the other parent must have a Felony conviction. If we could get the term And changed to OR then grandparents who have a deceased child would have rights in a court of law to be granted visitation with their grandchild. As this would be sufficient for rights, we believe that this should go farther and that grandparents of a deceased child should have the same rights of the deceased person in order to protect and help raise the grandchild from a potentially destructive parent or living situation.
