Bad on you Marks and Spencer. It was your mistake, so please honour the order. The chairs were in stock at the time of ordering and a contract had been signed.

I paid for this chair in good faith. The error was not my fault. I also note that your terms stated that I wasn't allowed to cancel or amend the order so why should you be allowed to do just that?

This should be honoured - I paid in good faith expecting a product at the price stated - if it was a pricing error this is not my fault, it clearly is yours.

Payment was made and accepted. . Surely contract was accepted if emails on delivery were sent and money taken .... ?

There is no breach of contract here. M & S's advert for the 50p chair was exactly that. An advert (or invitation to treat). The offer actually occurs when you press 'pay' at the checkout. It is then down to M & S to accept that offer (which they state in their terms and conditions that acceptance if effected by the dispatching of the product and not on receipt of the payment you offered, but nobody ever reads these) they didnt take your payment, you offered it to them. So basically all M & S have done is reject your offer. There has been no breach of contract as a lot of you are stating because there was no contract in the first place. I'm as frustrated as the rest of you as I ordered one too. But sadly it's all above board.

I didn't purchase these chairs but I do think it is morally right to supply these at the price advertised.
