On behalf of the player community of the game Nova Empire, developed by GameBear Tech, we ask the Google Play Store and Apple App Store to investigate potential unethical profiteering by the developers of the game.

We would also like to invoke our rights as laid out in the Consumer Rights Act of 2015 concerning the purchase of digital content.

The player community has experienced crashes, freezes, glitches or bugs with almost every major large-scale event and to some degree in the general daily play for several months now. The general perception of the player community is that the causes of these issues most likely relates to infrastructure, hosting, software and/or hardware problems which GameBear Tech is experiencing, and despite many complaints and a very reasonable period being given to them to address and rectify the cause of the issues and complaints, there seems to be no reasonable solution to the problem forthcoming in the near future.

Therefore the general feeling of the player community is that our rights to functional software is being overlooked in terms of the Consumer Rights Act of 2015.

Although the player community accepts that some degree of problems might exist or and should be expected in newly designed software and that reasonable time is required to rectify it, the occurrence of these problems are too frequent, are largely unresolved despite numerous recorded complaints over time and this furthermore raises concerns that these issues may be causing secondary effects where the developers possibly benefit unethically through their in-app purchase system by:

1. Not readily offering to compensate all players equally and fairly, but rather choosing to address those who complain only, and / or

2. By offering compensation that is not even vaguely comparable to the losses which have been incurred due to faults relating to the software or hosting of the software, and / or

3. By unfairly accepting that most players will simply spend or outlay more money on in-app purchases to try and recover what they have lost or to restore them to their former state.

Furthermore, the general feeling of the player community is that GameBear Tech charges an exorbitant premium for their in-app purchases and it is thus expected from the player community that the developer will keep their software, IT infrastructure and hosting up to date and able to cope with the demand which is placed on it through their marketing. If they are unable to keep up with demands, the player community expects fair compensation or a reset of conditions prior to such mentioned problems.

The signatories on this petition agree to the statements made and concerns raised above and would like a investigation into the matter as well as a fair resolution to the situation being provided by the developer.
