The Issue

I respectfully submit this clemency request to address a miscarriage of justice that has followed me for the past fourteen years. Fourteen years ago, I was sentenced to 23 years for a charge that should have been overturned on direct appeal due to both a critical Wiggins issue and the inclusion of a non-existent crime in the indictment.

The indictment listed “attempted felony murder under 110-125.27,” a charge that should never have been applied because it is a legislative creature—not an intentional act—and therefore legally defective in this context. The presence of this erroneous charge violates fundamental principles of fairness and due process.

In Wiggins v. Smith (2003), the United States Supreme Court established that failures of this magnitude, especially those involving inadequate legal representation and procedural errors, warrant reversal on appeal. Despite the clarity of this precedent, the error in my case was never corrected, leaving me to serve a sentence built on a foundation that does not align with the law.

For fourteen years, I have lived under the weight of a conviction that should not have legally stood.

Transformation, Accountability, and Rehabilitation

Despite this grave legal error, I made the conscious choice to use my time in incarceration to grow, redeem myself, and uplift others. Instead of bitterness, I chose responsibility. Instead of hopelessness, I chose transformation.

These accomplishments represent years of dedication, growth, and reinvention. I have worked tirelessly to better myself and to create tools that can uplift communities, reduce violence, promote health, and inspire youth.

Why Clemency Is Warranted

My request for clemency is not an attempt to avoid responsibility. I accept responsibility for my past, and I have spent more than a decade proving my commitment to personal change and community betterment.

However, my conviction contains a fundamental legal defect—one recognized by established case law yet never corrected in my case. Clemency is the only remaining avenue to address this injustice.

Granting clemency would:

  • Correct a long-standing judicial error
  • Recognize my extensive rehabilitation and accomplishments
  • Allow me to reunite with my family
  • Enable me to bring my skills, businesses, and programs to society
  • Uphold the values of fairness, justice, and compassion

I am no longer the person I was 14 years ago. I am a builder, a mentor, an entrepreneur, a creator, and a community-driven leader. I am ready to return home and serve my community in the way I have prepared myself for over a decade.
