
Freedom For Keith Foster


- To the Public,
I am writing this letter of support on behalf of Keith Foster, his team, allies and supporters. As we stand with him during this time of unjust, we seek support for our friend, a father, an officer, and a hero to the Fresno community. As he has done for so many, the fight for HIS civil and human rights continues. The erroneous conviction of Keith Foster will not be ignored nor dissolved until his freedom is proclaimed.
In 2017, Keith Foster was loosely accused and convicted of conspiring to distribute heroin and marijuana in Fresno, CA. The charges brought against him were based solely on speculations and inferences from uncorroborated telephone calls. Even with the acknowledgement of insufficient evidence based upon court documents, Keith Foster was still sentenced to 48 months in prison by Senior Judge Anthony Ishii, who has continuously disregarded the circuit law willfully and intentionally. Judge Ishii has not only allowed the false crimes created by weak information received from wiretap conversations between Keith Foster and others; he used his power to approve the wiretaps. Aside from biased phone calls, the government has failed to present any evidence that Keith Foster ever possessed, sold or gave marijuana or heroin to anyone.
Judge Ishii has violated Foster’s rights of due process, equal protection of the law, and a fair trial. In addition to these actions, Judge Ishii has been disqualified twice to proceed in the case of Keith Foster on the account of violating Statutory Laws - 28USC 455a and b1 which states: 28USC (455a) Any justice, judge, or magistrate judge of the United States shall disqualify himself in any proceeding in which his impartiality might reasonably be questioned. And Statutory Law - 28USC 455b1: (b) He shall also disqualify himself in the following circumstances: (1)Where he has a personal bias or prejudice concerning a party, or personal knowledge of disputed evidentiary facts concerning the proceeding. Yet Judge Ishii continued to preside over Keith Foster’s case violating his constitutional rights.
These facts have remained neglected for far too long and denied in court while false narratives are being created and broadcasted by the media and misinformed community members. Enough is enough.
Unfortunately yet all too common in the African American community, Keith Foster was wrongly convicted of crimes incomparable to his nature and who he is known for by his community. Painted by the media as a villain and corrupt law officer, Keith Foster’s character has been slandered, defamed, and negatively portrayed by those who lack the real evidence. The Keith we know is favored nothing close to what has been depicted of him. His position as deputy chief he lead honorably and took seriously. His dedication to the police force, his community, and family is unmatched. Yet he's been accused of acts of destruction that are untrue and bare unreliable evidence.
Keith Foster is overdue for what he deserves - a fair trial and his freedom according to the First Step Act which states that: (a) A prisoner in custody under sentence of a court established by Act of Congress claiming the right to be released upon the ground that the sentence was imposed in violation of the Constitution or laws of the United States, or that the court was without jurisdiction to impose such sentence, or that the sentence was in excess of the maximum authorized by law, or is otherwise subject to collateral attack, may move the court which imposed the sentence to vacate, set aside or correct the sentence.
Keith Foster continues to diligently fight for his voice to be heard and acknowledged. As of December 2019, Keith Foster has filed numerous motions such as motion 28 U.S.C 2255 which states that: (a) A prisoner in custody under sentence of a court established by Act of Congress claiming the right to be released upon the ground that the sentence was imposed in violation of the Constitution or laws of the United States, or that the court was without jurisdiction to impose such sentence, or that the sentence was in excess of the maximum authorized by law, or is otherwise subject to collateral attack, may move the court which imposed the sentence to vacate, set aside or correct the sentence.
Your support is needed and appreciated at this time to assist in gaining the freedom for a man who has been treated unjustly.
