Subject: Indulging in fraudulent activities by wrongly collecting money

I am writing this complaint to you under deep distress and agony having been fraudulently deprived of my hard-earned money organization and I am seeking your intervention to help obtain refund of the same.

My travails started when I had received a call from your organization ‘Bagittoday’ on January 19th 2013, informing me that I won a Jackpot Hamper from your company as I had taken part in a contest in March 2012 and that if I purchase any products online from your side, my paid money against these products will be refunded within 45 days. In good faith, I purchased the products (order #: 1018300678, 1018300703) through my credit card for a sum of Rs. 33,200. Attached is the copy of the same as Annexure I.

However, when I received hamper and I enquired about my refund, your executive straight away denied saying there was no such scheme by your company. I was shocked and filed a complaint to your higher authorities. On 19th February, I got a call from your company saying that the process of refund has been suspended by your ‘money back department’ due to the complaint I filed so I have to deactivate the complaint to allow the process of refund to get processed and reach me in 45 days.

On 22nd February 2013, I again got a call from your company, this time saying that there was a shortfall of Rs.15,999 to complete my refund of Rs.33,200 and so if I pay Rs.15,999 more then I would get a cheque of Rs.50,000 on 30th March 2013. I did not commit anything to them and I later again got a call from your company asking me to pay Rs.15,999 through my credit card. Moreover your executive, one Mr.Rahul Khanna who was on other end of the call asked me the details of my credit card including transaction password but better sense prevailed on me, and rightly I had refused to get induced any further and had insisted on refund of my original amount. However he insisted that I pay Rs.15,999 to get a complete refund of Rs.50,000. I have with me all the calls recorded which were made by your executives.

On further insistence from my side, your company finally declared that since my call has been verified by your company executives and I have been using the products I bought, no refund could be given to me by your company. I am shocked and feel totally cheated to hear this. It was clearly mentioned by your executives on their first phone call to me that the money I buy the products with would be refunded to me within 45 days. That was the reason why I bought the products in the first place.

However, now I realize that I have been totally fooled by your company. This is totally ridiculous and clearly reflects the wrong and fraudulent practices your company employs to dupe people. Added to this, your company is now saying that some credit points would be given to me if I send the products back. But this is unacceptable to me and I was never been told anything regarding this. I was only promised by your executives that my money would be refunded if I buy the products so I am not going to give back the products to your company and want a refund of the total amount I paid towards buying those as originally promised by your company executives.

I have suffered a total loss of Rs. 33,200 for trusting your company to be an authentic one but I have been cheated. Apart from killing my valuable time and energy, your company has caused me an immense amount of mental stress too.

I am extremely disappointed with your pathetic services and feel totally cheated. I, therefore, ask you to intervene in the matter and make sure that I get my entire refund money immediately.

As a consequence of your deficient service and the repeated incompetency displayed by your employees, I have suffered undue hardship and mental frustration.

I would like to emphasize that:

You have been grossly negligent in resolving my complaint.I have undergone a lot of extreme stress and mental agony because of your deficient service.

Given the above sequence of events, I request you to arrange for an immediate refund of my money. In addition, I request you to compensate me with an amount of Rs. 10,000 for the extreme stress and mental agony you have caused to me and the cost incurred by me in trying to resolve my grievance.

In case you fail to look into the matter within 15 days from the date of this letter, we would be forced to:

Ask our lawyers to file a consumer complaint against you for gross negligence, and deficient service, as well as additional compensation for mental agony and legal costs;Ask our lawyers to consider the filing of a civil suit against your companyStart a sustained online campaign spreading the word about the appalling level of service that we have received from you; andIssue press releases online and in the print media.

We hope that we do not have to take these steps and look forward to an amicable resolution of this issue.
