The reality is that when all other options have been exhausted there is very little risk associated with the result. Offer a waiver of liability, have the parents be informed that it is a trial and of the risks.

Without knowing the full story it's hard to know why the drug is being withheld. However it would be ideal if the decision to use the drug lay with the parents and treating medical specialists rather than a pharmaceutical giant.
