The province should review the Child Family and Community Services Act, and make some serious changes!
According to the Canadian Charter of Rights and Freedoms:
Everyone has the right to life, liberty and security of the person and the right not to be deprived thereof except in accordance with the principles of fundamental justice;
What happens when those principles for example of the Child Familiy and Community Services Act violates parents rights?
The DIRECTOR dose not have to comply to the act and just stomp on parents rights who know what happens to children in foster care.
Section 30 violates our rights since the Director of MCFD CHILD PROTECTIVE SERVICES can remove any child without a court order: 30 (1) A director may, without a court order, remove a child if the director has reasonable grounds to believe that the child needs protection.
A director may, without a court order and by force if necessary A director may, without a court order and by force if necessary, enter any premises never the less the act; states the director has reasonable grounds to believe that the child is in need of proctection. (Emphasis mine) Since the Director can remove a child from any premises by force that is in violation to our right see Sections 7 through to 12 of the Canadian Charter of rights and freedoms Life, liberty and security of person, and Legal rights!
The Child Family, and Community, Services, Act in <?xml:namespace prefix = st1 ns = "urn:schemas-microsoft-com:office:smarttags" />Canada states:
Guiding principles section 2: The act must be administered so that the safety and well-being of children are the paramount consideration and in accordance with the Following principle: (a) child is entitled to be protected from abuse neglect, and harm or threat of harm. I belive that part of an integeral safety for children would be having the Child Familiy and Community Services Act reviewed as it would be parmount in any consideration! It is understood that children are entitled to be protected from harm or threat of harm. However parents have that right to according to the Canadian Charter of Rights and Freedoms; In respect to child protection it is in violation to parents rights; SEARCH OR SEIZURE. 8. Everyone has the right to be secure against unreasonable search or seizure. Any where in respect to the principles of the CFSCA where it violates parents rights it needs to be revised. Mary Ellen Turpel- Lafond’s reports “She is deeply disappointed with the child welfare system,and the government's progress."If parents rights were properly protected, Mary Elen Turpel-Lafond,wouldn’t be so disappointed! MaryEllen Turpel- Lafond said she is “particularly critical, of what she sees as a lack of accountability,"regarding the Ministry for Children and Families. The lack of accountability is that parents have no rights according to child protection services. Prior to Mary Ellen Turpel- Lafond'sreport the MCFDMinister, Mary Plocak; had been trying to cover up just how corrupt the Child welfare system really is! Since the above reportswere stated by the government, parents wonder if they will ever have justice, there will be if we fight together, to put an end to abusive MCFD and Ministry of NO ACCOUNTABLITY! I believe that if Parentsrights wereprotected; there wouldn’t be the number of child deaths, reported in the care of the Ministry, children vulnerable to abuse, or have to suffer serious injuries! It would avoid senseless tragedies for both children, and parents! I believe that If the MCFD has removed a child that parent still has the rights to be treated with dignity and respect in accordance to the Canadian Charter of Rights and Freedoms: In conclusion anywhere the Child Family and Community Services Actis is in serious violation to parent’s rights it must be revised and the government needs to treat parents rights more seriously.GOAL 5000 SIGNATURES I am taking this to the Legislative assembly, because parents rights do matter,and further more parents have taken CPS abuse for long enough FIGHT BACK sign this petition and say no more CPS ABUSE!SIGN TODAY!
