77-15-9 Form of Petitions

Pursuant to the current discretion of police officers on selective enforcement of the law in Bernalillo county, we the people, signed herewith on this petition, do feel that the following law is being seriously violated causing the people of this county to lose confidence and support of the department:

29-1-10. [Law enforcement agencies, state and local; participation in federal programs.]

All state and local law enforcement agencies are hereby authorized to participate in the Federal Law Enforcement Assistance Act of 1965 (Public Law 98-197 [89-197]).

History: 1953 Comp., § 39-1-11, enacted by Laws 1966, ch. 24, § 1.

The registered voters in this petition move to create the enforcement of said law by every police officer which, upon the presentation of evidence to the officer, shall ensure that the law is enforced every time, for every citizen. Currently, the enforcement of the law is highly selective. In previous issues within the county of Bernalillo, the petitioners believe that there has been a significant failure on the part of the Albuquerque Police Department to equally and fairly apply the law to all citizens. As this is the United States of America where all people are to be created equally, the application of all laws, equally to all citizens is of paramount importance. In an effort to create better relations between the people of this county, and the Albuquerque police department, we require that the county begin to apply penalties to each and every officer which violates this fair application of the laws, within this county. This can be easily achieved through the counties current use of lapel cameras. When said officers are in violation of the above law, those officers will be imminently fined and disciplined.
