The federal government is not our "savior" stop acting as though you are. There is absolutely no evidence that masks work to stop the spread. Actually, it's the opposite.

The Supreme Court of Alabama has addressed the limited authority granted to the Alabama Board of Education (and by inference, local school boards within the state). "However broad may be the powers of the State Board of Education, we think it clear that the authority to exercise general control and supervision over the county boards of education does not include the authority to exercise the powers and authority which the Legislature has specifically conferred upon such local boards." In re Opinion of the Justices No. 180, 276 Ala. 239, 241, 160 So.2d 648, 650 (1964). Alabama Code Section 16-1-30(b) does not authorize the State Board of Education to grant to local school boards the power or authority to practice medicine, however noble the intent may be. In Alabama, the "practice of medicine" means to "diagnose, treat, correct, advise or prescribe for any human disease, ailment, injury, infirmity, deformity, pain or other condition, physical or mental, real or imaginary, by any means or instrumentality". See Ala. Code § 34-24-50(1). Forcing children to wear face masks, to address concerns about the spread of disease (according to the beliefs held by the BoE) clearly constitutes the practice of medicine. The Legislature of Alabama has not given the State Board of Education authority to practice medicine. Clearly, the Madison School Board is practicing medicine by prescribing face masks for the purpose of furthering it's medical opinion about matters related to health and safety. In other words, the Madison Board of Education is making independent health decisions for students, including those students who oppose the mandated medical treatments. Forcing children to undergo medical treatment constitutes unlawful exercise of police powers; a power the Legislature of Alabama has not conferred upon school boards at any level within the state. Fortunately, parents, teachers, and staff do have legal authority that supports their position to wear or not to wear at m

Margaret Dubose and the diocese should be ashamed for how they are treating the families who choose Catholic education. The lack of communication and transparency on her decision making process is totally unacceptable. The data does not merit the extreme measures she continues to take with our children.

No mask mandates for healthy children — or adults. We have a duty to protect the vulnerable but every child has a God endowed natural right to breath freely.

Masks should be a decision made between the parents and the children. They are terrible for a child with asthma and eczema. There should be more focus on education and less chastising/yelling if the mask drops below their nose or for walking down an empty hallway without your mask on. If we can attend sporting events, go to restaurants, malls, etc without wearing a mask, then the children should attend school without a mask. HAND HYGIENE and coughing in your elbow is the key to not getting sick….not masks.

The CDC finally admitted recently that these mask were for show only. There is no benefit to our children, only detrimental

The continued forced masking of our Catholic school students with no apparent end goal, demonstration of need or effectiveness, or acknowledgement of the downsides must end. It shames me to my core that three year olds in our Catholic schools are being forced to do this the majority of their waking hours. I have a son that will be three this summer and he will not be attending pre-school in a Diocese school if this continues. I will also pursue other educational options for my elementary students if there is not a clear end to this masking policy this spring.

Before we require masks for everyone, I guess we should walk a mile in your shoes. Unfortunately we can’t fit into your YUGE shoes because you’re all a bunch of anti-science clowns.

Masks impair my freedom to move around easily. If individuals want to put others at risk by spreading disease, that is their right! If parents don't have the right to decide if masks are right for their child, that starts a slippery slope to requiring other clothing as well, like pants.

The Diocese has no authority to require masks since there is little to no actual science behind them stopping the spread of an air born virus. If that were true, then we would have been doing it for the flu, and the common cold. There is also the factor that COVID is less virulent with the Omicon version, and the effect on children is very little and mostly asymptomatic. I support allowing parents to choose for their own children whether masking is the right decision for them. It is a family choice not a bureaucratic one, even if the organization is religious in nature.

This petition is very well stated. Thank you for this petition. Forcing children with natural immunity to wear a mask out if fear is foolish.
