In American society today, there is a lot weight put into one's overall appearance and presentably; this is especially true in the world of employment. As a country we have taken great strides to eliminate the discrimination against individuals in the workplace based on their gender, race, and religion. However, what we have not addressed as a country is the discrimination against people with tattoos and piercings.
Currently in action to prevent discrimination in the workplace is Title VII of the Civil Rights Act of 1964. However, Title VII to only include protection from discrimination against race, religion, sex and national origin. So because tattoos and piercings do not fall under any of those categories and are considered alterable characteristics, they are not protected under the Title VII of the Civil Rights Act of 1964. This leaves companies with full power to fire or refuse to hire individuals with tattoos or piercings.
To fully protect tattooed and pierced individuals from discrimination in the workplace under the law, we have to amend the Civil Rights Act of 1964’s Title VII to include tattoos and piercings within it’s categories under protection. This will give them protection from discrimination in the workplace by not allowing employers to fire or not hire them solely based on their having tattoos/piercings and it would also allow them to have their tattoos and piercings visible in the workplace.
Their tattoos and piercings are apart of them in the same way that their sex, race, religion, and national origin are apart of them, so why not view them the same and allow them to be protected the same way?
