- Pennsylvania court of appeals says SEPTA isn’t subject to city anti-discrimination ordinance (banning discrimination based on sexual orientation and gender identity)- August 2015

- Commonwealth court stated SEPTA is only subject to state non-discrimination law

- Outcome: court states “applying local law to SEPTA would be unwieldy because it operated in over 100 jurisdictions”

- Ordinance refused to accept: Philadelphia Fair Practices Ordinance

-Complaints filed with Philadelphia Commission on Human Relations

- SEPTA says only subjected to Pennsylvania wide non-discrimination policy

- SEPTA states it would be unduly burdensome to be required to comply with every city ordinance since SETPA covers many jurisdictions

- SEPTA current non-discrimination policy: “Title VI- protects passengers from discrimination based on race, color, national origin” and states “SEPTA complies with all Pennsylvania Human Relations Act”
