Petition of ECIA Members to ECIA Board of Directors:

WHEREAS the New Mexico Court of Appeals ruled that Section 11 of the Eldorado Covenants does not “preclude the owners from keeping their hens as recognized household pets,” and the ECIA Board has agreed to abide by that ruling; and WHEREAS the restoration of harmony in the community and financial interests of the members, while adequately protecting our community, would be best served by the following actions; the UNDERSIGNED hereby request that the Board 1) take no further actions in this matter for two years from June 1st, 2016, unless it receives at least six verified, documented specific complaints from adjacent neighbors of members keeping pet hens, whereupon 2) the Board may consider creating of an ad hoc committee to address such disputes toward their resolution.

The courts have ruled in this case and I think their decision should be honored.

Increasing numbers of cities. towns and subdivisions allow chickens. This website alone has over 100 pages listing locations all over the US. http://www.backyardchickens.com/atype/3/Laws/sort/new/page/10/ Eldorado is one of the most appropriate places to allow this, given its large lots.

What this petition says in plain English is that the Court has ruled, so until some actual problem can be documented, the community can take a break from even thinking about chickens.
