Whereas, State of California Ed Code (44929.21-25) states that adult education certificated personnel who serve a minimum of two consecutive years at 605 FTE in an adult education program at a state-supported institution, that teacher has satisfied probationary time and is thereby accorded the rights and privileges of full-time or permanent status. Therefore, we, the undersigned consisting of adult education teachers and adult students in the Los Angeles Unified School District demand that the School Board of the Los Angeles Unified School District, without pause or prejudice, inform the Division of Adult and Career Education (DACE) of ed code 44929.21-25 and instruct this division to bring the division into compliance and retroactively award tenure to all teachers who have satisfied the legal requirement for permanent status and henceforth to comply with regulations regarding tenure in awarding tenure to teachers who qualify for tenure under this provision of state ed code. Furthermore, the School Board is put on notice to order DACE to abolish present tenuring protocol, which is "open" when DACE sees fit, highly subjective and arbitrary, and is nowhere prescribed or provided for in state ed code. Conversely, Tenure shall be "open" according to state ed code, year-round so long as teachers qualify for tenure according to provisions set forth on State Ed Code 44929.21-25 The School Board is also enlighterned that tenure in adult education, according to state ed code, is not "Tenure in ESL" or "Tenure in Academics" or "Tenure in Older Adults," a willy-nilly that DACE has devised contrary to the tenets of State Ed Code, which elucidates that tenure in adult education encompasses but one domain: ADULT ED. Teachers are permitted to teach in any area--ESL--Academics--Older Adults--so long as their credential, per state ed code, covers the discipline. The system of tenuring heretofore has not ony been unfair and impartial, it is also illegal. We the undersigned, registered voters residing in Los Angeles and/or adult education teachers (permanent and part time) and/or students in Adult education in LAUSD advise,beseech, expect and demand that the School Board act at once to dismantle the present form of tenuring employed by DACE and to get them into full compliance with state ed code regarding tenuring of adult education teachers. This means the granting of tenure to all teachers who qualify according to state ed code. This includes tenuring retroactive to the date that respective teacher obtain full-time status according to state ed code.
